An act passed by the General Assembly and approved February 16, 1866, provided that “all taxes collected from negroes and mulattoes in the Commonwealth, shall be set apart and constitute a separate fund for their use and benefit, one half, if necessary, to go to the support of their paupers, and the remainder to the education of their children.”
