On March 2, 1960, the legislature approved an act "relating to the erection of a statue in memory of Alben William Barkley."
The State Property and Buildings Commission was to contract with a "qualified sculptor" who was to "create by appropriate and
recognized methods a lifesize statue."
Upon completion and acceptance by the Commission, the statue was to be placed in the rotunda of the Capitol. The statue was to
be "so constructed as to harmonize with those statues presently located in the rotunda of the Capitol."
