Tiering

What is tiering? Treating differently situated entities differently.

Why would someone use tiering?

· Sometimes it doesn't make sense to treat every entity the same way. For example, it wouldn't make sense for a restaurant that seats 30 people to be required to have the same number of restroom stalls as a restaurant that seats 300. In cases like this, it is a benefit to treat different sized or differently situated entities differently. See KRS 13A.210(2) for other instances where tiering may be applied.

How do I get a number for a new administrative regulation?

Contact the Regulations Compiler's office and provide the following information:

· An idea of the Title and Chapter number in which the administrative regulation may be placed. Requests are honored, if possible; however, a number that was previously used will not be available;

· A tentative title for the new administrative regulation; and

· The name of the person requesting the new administrative regulation number.

How are letters filed with the Regulations Compiler?

Format of the Letter

· On agency letterhead; and

· Includes a signature.

Submission Possibilities

· Email a letter (that is on letterhead and contains a signature) to the Regulations Compiler;

· Hand deliver a hard copy to the Capitol Annex - Room 29, 702 Capitol Avenue, Frankfort, KY 40601; or

· Send a hard copy to: Regulations Compiler, Capitol Annex - Room 29, 702 Capitol Avenue, Frankfort, KY 40601.
