201 KAR 13:040. Licensing; application, examination; temporary permit; inactive status. In response to questions by Senator Roeding, Mr. Smith stated that while this administrative regulation increased the fee for the practical examination from $25 to $50, that fee now included the cost of the license, which previously required a separate application and fee.

In response to a question by Chairman Arnold, Ms. Klusch stated that the Commission on Accreditation in Physical Therapy Education accredited physical therapy programs.

Board of Certification for Professional Counselors
201 KAR 36:020. Fees - renewal date. Nancy Black, Division of Occupations and Professions, and Jim Grawe, Assistant Attorney General, represented the Board.
In response to questions by Senator Roeding, Mr. Grawe stated that this administrative regulation established the certification, renewal, refund, and late fees for professional counselor associates, which was a new classification established during the 2000 Regular Session.
Ms. Black stated that the current fees for existing classifications were not changed in this administrative regulation.
This administrative regulation was amended as follows: (1) Section 1 was amended to provide for a refund for a professional counselor associate applicant upon denial; and (2) Section 2 was amended to set the renewal fee, late renewal, and reinstatement fee for a professional counselor associate.
201 KAR 36:070. Education requirements. This administrative regulation was amended as follows: (1) the NECESSITY, FUNCTION, AND CONFORMITY paragraph was amended to clearly state the necessity for and function served by this administrative regulation, as required by KRS 13A.220(3)(f); and (2) Section 1 was amended to provide the standards for a degree in counseling, a degree in a related field, and a regionally-accredited institution.

401 KAR 8:010. Definitions for 401 KAR Chapter 8. Jack Wilson, Director, Division of Water, and Vicki Ray, Branch Manager, represented the Division.
In response to a question by Chairman Arnold, Ms. Ray stated that private water systems served three households or less, and public water systems served more than twenty-five people. A semipublic water system was a water system that did not meet the requirements for either a private or public water system. This administrative regulation was amended to clarify the definitions of private, public, and semipublic water systems.

Office of Aeronautics: Airport Zoning Commission
602 KAR 50:010. Definitions relating to 602 KAR Chapter 50. Hollie Spade, Office of General Counsel, and Ron Bland, Administrator, Kentucky Airport Zoning Commission, represented the Office.
In response to a question by Senator Long, Ms. Spade stated that this administrative regulation did not change requirements regarding an airport zoning commission’s ability to override a local zoning commission.
Mr. Bland stated that, under existing provisions, an airport zoning commission was authorized to override a local zoning commission regarding matters of aviation, but was not authorized to override in matters of location.

This administrative regulation was amended as follows: (1) the STATUTORY AUTHORITY paragraph was amended to correct statutory citations; (2) Sections 1 through 5 were amended to comply with the drafting and format requirements of KRS Chapter 13A; (3) Section 2 was amended to clarify that only a licensed facility offering a full range of required services may be called a "hospital;" (4) Section 4 was amended to add other ordering personnel to those who are qualified to administer medications; and (5) Sections 3 and 4 were amended to permit a member of the medical staff to sign a telephone order for medications or diagnostic testing or treatment, within 72 hours of the order's receipt.
Department for Mental Health and Mental Retardation Services: Kentucky Traumatic Brain Injury Trust Fund Board
908 KAR 4:030. Traumatic Brain Injury Trust Fund operations. Colleen Ryall, Staff, Kentucky Traumatic Brain Injury Trust Fund Board of Directors, and Bruce Scott, Director, Division of Mental Health, represented the Board.
In response to questions by Senator Roeding, Ms. Ryall stated that this administrative regulation established the procedures for accessing the fund and the Board hoped that the established procedures would make it easier for citizens to access the fund. She briefly summarized the procedures established in this administrative regulation for accessing the fund.
This administrative regulation was amended as follows: (1) the RELATES TO paragraph was amended to correct a statutory citation; (2) the NECESSITY, FUNCTION, AND CONFORMITY paragraph and Sections 1, 2, 3, 4, 6, 7, 8, 9, and 10 were amended to comply with the drafting and format requirements of KRS Chapter 13A; (3) Section 1 was amended to add a definition of “behavior programming”; and (4) Section 7 was amended to specify available benefits.
