13 KAR 1:030. Campus security, private institutions. Dianne Bazell, Senior Associate for Academic Affairs, and Dennis Taulbee, General Counsel, represented the Council.

 

This administrative regulation was amended as follows: (1) the RELATES TO and STATUTORY AUTHORITY paragraphs were amended to correct statutory citations; and (2) the NECESSITY, FUNCTION, AND CONFORMITY paragraph and Sections 1, 6, 7, and 8 were amended to comply with the drafting and format requirements of KRS Chapter 13A.

 

Public Educational Institutions

 

13 KAR 2:025. College preparatory education. This administrative regulation was amended as follows: (1) the RELATES TO and STATUTORY AUTHORITY paragraphs were amended to correct statutory citations; (2) the NECESSITY, FUNCTION, AND CONFORMITY paragraph was amended to clearly state the necessity for and function served by this administrative regulation, as required by KRS 13A.220(3)(f); and (3) Sections 1 and 2 were amended to comply with the drafting requirements of KRS Chapter 13A.

 

13 KAR 2:045. Determination of residency status for admission and tuition assessment purposes. This administrative regulation was amended as follows: (1) the RELATES TO paragraph and Sections 1 and 9 were amended to correct statutory citations; and (2) Sections 1, 2, 6, 8, 10, 11, 13, and 14 were amended to comply with the drafting and format requirements of KRS Chapter 13A.

Kentucky Employees' Retirement System: General Rules

 

105 KAR 1:020. Reciprocal program between CERS, KERS, SPRS, TRS, JRP and LRP. Eric Wampler, Counsel, Gerri Miller, Deputy Commissioner of Benefit Services, and James Dodrill, Counsel, represented the System.

 

In response to questions by Representative Bruce, Ms. Miller stated that only the System’s under age sixty-five (65) health insurance plans were contracted through the Personnel Cabinet. Their over age sixty-five (65) plans were contracted through Anthem, Blue Cross, Banker’s Life, and Humana.

 

This administrative regulation was amended as follows: (1) to include authorizing language in the NECESSITY, FUNCTION, and CONFORMITY paragraph; (2) to cite KRS 61.680(7) in Section 2, Subsection (2), concerning the determination of final compensation; (3) to specify citations; and (4) to comply with the drafting and format requirements of KRS Chapter 13A.

 

105 KAR 1:120. Participation of agencies. This administrative regulation was amended as follows: (1) to include authorizing language in the NECESSITY, FUNCTION, and CONFORMITY paragraph; (2) to correct and specify citations; and (3) to comply with the drafting and format requirements of KRS Chapter 13A.

105 KAR 1:240. Death after retirement procedures. This administrative regulation was amended as follows: (1) the NECESSITY, FUNCTION, AND CONFORMITY paragraph was amended to clearly state the necessity for and function served by this administrative regulation; and (2) Sections 7 and 8 were amended to comply with the drafting requirements of KRS Chapter 13A.

 

105 KAR 1:300. Determination of service credit for classified employees. This administrative regulation was amended as follows: the STATUTORY AUTHORITY paragraph was amended to add a statutory citation.

 

105 KAR 1:310. Red Capps Memorial Act. In response to a question by Chairman Arnold, Mr. Dodrill stated that this administrative regulation was amended to require dependent children who were full-time students to verify their student status at the beginning and end of each semester, for a total of four verifications per year.

 

This administrative regulation was amended as follows: Section 5 was amended to correct a KRS Chapter 13A drafting error.

 

105 KAR 1:330. Purchase of service credit. This administrative regulation was amended as follows: Section 4 was amended to correct a KRS Chapter 13A drafting error.

 

105 KAR 1:350. Collection of account without formal administration of estate. This administrative regulation was amended as follows: (1) the STATUTORY AUTHORITY paragraph was amended to add a statutory citation; (2) the NECESSITY, FUNCTION, AND CONFORMITY paragraph was amended to clearly state the necessity for and function served by this administrative regulation; and (3) Section 1 was amended to comply with the format and drafting requirements of KRS Chapter 13A.

201 KAR 8:450. Dental hygienist services when supervising dentist not physically present. Gary Munsie, Director, and Mark Brengelman, Assistant Attorney General, represented the Board.

 

This administrative regulation was amended as follows: (1) the STATUTORY AUTHORITY paragraph was amended to add a statutory citation; (2) the NECESSITY, FUNCTION, AND CONFORMITY paragraph was amended to clearly state the necessity for and function served by this administrative regulation; (3) Section 1 was amended to delete unneeded definitions; and (4) Sections 3 to 8 were amended to comply with the drafting and format requirements of KRS Chapter 13A.

 

Department Of Agriculture: Livestock Sanitation

 

302 KAR 20:040 & E. Entry into Kentucky. Mark Farrow, General Counsel, Dr. Don Notter, State Veterinarian, and Allen Johnson represented the Department.

 

In response to a question by Senator Pendleton, Mr. Farrow stated that neither this administrative regulation nor 302 KAR 20:065 affected game preserves or chronic wasting disease in captive cervids. The Department was in the process of promulgating 302 KAR 20:066 to address those issues.

 

This administrative regulation was amended as follows: (1) the STATUTORY AUTHORITY and NECESSITY, FUNCTION, AND CONFORMITY paragraphs and Sections 1 to 5, 7, and 13 were amended to specify statutory and regulatory citations; (2) Sections 2, 4, and 5 were amended to use defined terms; (3) Section 3 was amended to establish the requirements for an approved horse sale; and (4) Sections 1 to 14 and 16 were amended to comply with the drafting and format requirements of KRS Chapter 13A.

 

302 KAR 20:065 & E. Sale and exhibition of Kentucky origin livestock in Kentucky. This administrative regulation was amended as follows: (1) the STATUTORY AUTHORITY and NECESSITY, FUNCTION, AND CONFORMITY paragraphs and Sections 1, 4, 6, 8, 10, and 12 were amended to specify statutory and regulatory citations; (2) Sections 4, 8, and 13 were amended to use defined terms; and (3) Sections 2, 4, 5, 6, 7, 8, 10, and 12 were amended to comply with the drafting and format requirements of KRS Chapter 13A.

 

302 KAR 20:250 & E. Avian influenza. This administrative regulation was amended as follows: (1) Section 1 was amended to establish definitions for AGID, ELISA, Flock affected with low pathogenic Avian Influenza, Low pathogenic Avian Influenza, and State Affected with low pathogenic Avian Influenza; (2) Sections 3 to 11 were deleted because they were outdated and were replaced with: (a) entry requirements for unfed baby chicks or hatching eggs from states affected with low pathogenic Avian Influenza; (b) transportation requirements for chicks, poults, or hatching eggs from states affected with low pathogenic Avian Influenza; (c) entry requirements for live poultry and poultry products from states affected with low pathogenic Avian Influenza; (d) entry requirements for poultry originating from Kentucky that had been transported to a state affected with low pathogenic Avian Influenza; and (e) cleaning and disinfecting requirements for vehicles used to transport poultry or poultry products from states affected with Avian Influenza; and (3) the RELATES TO, STATUTORY AUTHORITY, and NECESSITY, FUNCTION, AND CONFORMITY paragraphs and Sections 1, 2, 12, and 13 were amended to comply with the drafting and format requirements of KRS Chapter 13A.

This administrative regulation was amended as follows: (1) the NECESSITY, FUNCTION, AND CONFORMITY paragraph was amended to state clearly the necessity for this administrative regulation; (2) Section 2 was amended to use a defined term; (3) Section 5 was added to establish a penalty provision for regulatory violations; and (4) Sections 2 and 4 were amended to comply with the drafting and format requirements of KRS Chapter 13A.

This administrative regulation was amended as follows: (1) the STATUTORY AUTHORITY and NECESSITY, FUNCTION, AND CONFORMITY paragraphs were amended to correct statutory citations; (2) the NECESSITY, FUNCTION, AND CONFORMITY paragraph and Sections 1, 2, and 6 were amended to change references from “chief state school officer” to “commissioner of education”, to comply with statutory language; and (3) Section 2(1) was amended to comply with the drafting and format requirements of KRS Chapter 13A.

 

Public Protection And Regulation Cabinet: Department of Insurance: Health Care Malpractice

 

806 KAR 40:020. Charitable health care provider registration. Carrie Banahan, Glen Jennings, Deputy Commissioner, and Robin Coombs represented the Department.

 

In response to a question by Representative Bruce, Mr. Jennings stated that this administrative regulation required some additional documentation from charitable health care providers to prevent the providers from attempting to obtain reimbursement for insurance costs beyond medical malpractice premiums.

 

This administrative regulation was amended as follows: (1) to add citations to the STATUTORY AUTHORITY paragraph; (2) to include authorizing language in the NECESSITY, FUNCTION, and CONFORMITY paragraph; and (3) to comply with the drafting and format requirements of KRS Chapter 13A.

 

Kentucky Mine Safety Review Commission: Mine Safety Review

This administrative regulation was amended as follows: (1) the RELATES TO paragraph was amended to add statutory citations; (2) Section 1 was amended to delete definition of "quorum"; (3) Section 4(1) and (5) were amended for clarity; (4) Section 4(2), (9), (11), (12), and (14) were amended to delete unauthorized requirements; and (5) Section 10 was amended to correct a minor drafting error.

902 KAR 55:025. Schedule III substances. Jim Carreer, Legislative Liaison, and Danna Droz, Manager, Drug Enforcement Branch, represented the Department.

 

In response to questions by Representative Lee, Ms. Droz stated that there were no fee increases in the amendments to 902 KAR 55:025 to 902 KAR 55:090. Additionally, the Department had notified and worked with the Pharmacists Association and the American Pharmacy Services Corporation, and health care systems, pharmacists, and local pharmacists associations throughout the state in finalizing the amendments to those administrative regulations.

 

This administrative regulation was amended as follows: (1) the RELATES TO and STATUTORY AUTHORITY paragraphs were amended to correct statutory citations; and (2) Sections 3 and 6 were amended to correct minor drafting errors.

 

902 KAR 55:030. Schedule IV substances. This administrative regulation was amended as follows: the RELATES TO and STATUTORY AUTHORITY paragraphs were amended to correct a statutory citation.

 

902 KAR 55:090. Exempt anabolic steroid products. This administrative regulation was amended as follows: (1) the RELATES TO and STATUTORY AUTHORITY paragraphs were amended to correct a statutory citation; and (2) the NECESSITY, FUNCTION, AND CONFORMITY paragraph was amended for clarity.

 

Department for Medicaid Services: Services

 

907 KAR 1:055 & E. Payments for primary care center, federally-qualified health center, and rural health clinic services. Duane Dringenburg represented the Department.

 

In response to questions by Chairman Arnold, Mr. Dringenburg stated that this administrative regulation replaced cost-based reimbursement for primary care centers, federally qualified health care centers, and rural health care centers with a fee for services program, as required by the Balanced Budget Act of 1997 and the SCHIP Benefits Improvement and Protection Act (BIPA) of 2000.

 

This administrative regulation was amended as follows: (1) the RELATES TO and STATUTORY AUTHORITY paragraphs were amended to correct statutory citations; (2) the NECESSITY, FUNCTION, AND CONFORMITY paragraph was amended to clearly state the necessity for and function served by this administrative regulation, as required by KRS 13A.220(3)(f); and (3) Sections 1, 2, 3, 4, and 6 were amended to comply with the drafting and format requirements of KRS Chapter 13A.

806 KAR 17:221. Repeal of 806 KAR 17:220. Carrie Banahan, Glen Jennings, Deputy Commissioner, and Robin Coombs represented the Department.

 

In response to questions by Chairman Arnold, Ms. Banahan stated that before the Department would approve an insurer’s network for participation in the state employee health insurance program, the Department required the insurer to meet certain accessibility standards including a sufficient amount of primary care providers, hospitals, and pharmacies within thirty (30) minutes or thirty (30) miles of an employee’s place of work or residence. Additionally, the Department could investigate specific complaints regarding an individual employee’s lack of access to providers. However, the Personnel Cabinet, rather than the Department, was authorized to investigate and regulate wider reaching accessibility problems for state employees, such as insufficient providers to serve a particular county.

 

In response to a question by Chairman Arnold, Ms. Banahan stated that this administrative regulation repealed 806 KAR 17:220, which established reentry requirements for insurance carriers, because those requirements served as a barrier for carriers to return to the Kentucky market.
