HORSE PARK, KENTUCKY:

Georgetown Scott County Parks and Recreation, 0800007063. Lindsey Flora, Michael Scales and Joe Hinton discussed the contract with the committee. A motion was made by Representative Crenshaw to consider the contract as reviewed. Representative Montell seconded the motion, which passed unanimously.

 

Andrew Hartley, Staff Attorney, Office of Legal Services; Amy Barnes, Branch Manager, Coal Development and Harry Carver, Renaissance Coordinator, Special Projects, Governor's Office for Local Development (GOLD) discussed GOLD's request regarding an exemption from the biennial restriction to extend for time only. This request was deferred from the May meeting and was due to projects which have not been completed. The committee granted the Department of Local Development an exemption to extend any of the listed contracts beyond the current biennium on the condition that any contract that Department of Local Development seeks to reject for reasons other than being completed or having a zero balance must be reported to the Committee prior to Department of Local Development action.  A motion was made by Representative Yonts to consider the contract as reviewed. Representative Crenshaw seconded the motion, which passed with Senator Gibson voting NO.

 

Angela Vest, Administrative Branch Manager, Division of Purchases and David Ray, Office of the Inspector General, KY Transportation Cabinet discussed an exemption request from the Government Contract Review Committee's Policy Statement #98-1 (travel waiver). This exemption would apply to Investigative Services' contractors for the Inspector General's office. The current hourly rate is $40 per hour.  The Transportation Cabinet requests that expenses, to include  mileage, meals and lodging, be reimbursed along with the $40 hourly rate. A motion was made by Representative Crenshaw to consider the contract as reviewed. Representative Montell seconded the motion, which passed unanimously.

 

Dennis Taulbee, General Counsel and Terry Pruitt, Adult Education, Council on Postsecondary Education discussed an exemption request to the contract review requirements in KRS 45A690. KRS 45A690 (1)(d)(11) allows the committee to exempt certain agreements, at its discretion, from consideration. This request is based on the routine and repetitive nature of the majority of MOAs and the fact that the funding is formula based with satisfactory performance over time as a requirement: State and Federally funded agreements created under Title II of the Workforce Investment Act of 1998, agreements for federal funds received form the US Department of Education, Title IV, for the Gaining Early Awareness and Readiness for Undergraduate programs grant and agreements for federal funds received form the US Department of Education for the Improving Teacher Quality State Grant program; part of the No Child Left Behind Act. A motion was made by Representative Scorsone to approve the exemption request. Representative Crenshaw seconded the motion, which passed unanimously.
