HB 261 (BR 895) - J. Barrows, J. Bruce, R. Damron

     AN ACT relating to school facilities construction and declaring an emergency.
     Amend KRS 157.615 to eliminate from the definition of "available local revenue" the balance of the general fund budget above 10% as a measure of wealth for school construction needs; and amend KRS 157.620 and 157.622 to require use of a school district's most current facility plan approved by the Kentucky Board of Education to determine unmet need and priority order.

HB 261 - AMENDMENTS


     HCS - Amend KRS 157.615 to delete from the definition of "available local revenue" the balance of the general fund as funds obligated for school building construction and include as components the bonding potential of capital outlay and building funds and account balances as of June 30 of odd-numbered years; delete from the definition of "equivalent tax rate" income from voted building taxes; amend KRS 157.620 to require local school boards to restrict available local revenue of June 30th of odd-numbered years, and to eliminate the requirements that interest income be deposited in the restricted account and that school facility plans be revised or reconsidered for inconsistency; and amend KRS 157.622 to require funding for school construction be applied to projects in the most current plan approved by the Kentucky Board of Education.
