HB 296/FN/LM/CI (BR 1127) - S. Westrom

     AN ACT relating to juvenile justice.
     Create, amend, and repeal numerous sections of KRS Chapters 600, 605, 610, 630, 645 and other statutes to limit secure detention of status offenders.

HB 296 - AMENDMENTS


     HCS/FN/LM/CI - Create, amend, and repeal numerous sections of KRS Chapters 600, 605, 610, 630, 645 and other statutes to specify circumstances when a child who commits a "status offense" may be detained and specify the type of facility for detention; add new definitions of "beyond control of parents" and "beyond control of school"; require reports to a judge prior to holding a status offender in secure detention; specify time frames for detention; require a finding that the child is subject to a valid court order before detention may be ordered.
     HFA (1, S. Westrom) - Specify the time frame for detention hearings.
     HFA (2, J. Vincent) - Require that the contempt punishment under KRS Chapters 600 to 645, the Juvenile Code, be in the sole discretion of the court.
     HFA (3, J. Vincent) - Require that the contempt punishment under KRS Chapters 600 to 645, the Juvenile Code, be in the sole discretion of the court.
     HFA (4, J. Vincent) - Require that the inherent contempt power of the courts shall not be diminished, notwithstanding the provisions of KRS Chapters 600 to 645, the Juvenile Code.
     HFA (5, J. Vincent) - Require that the inherent contempt power of the courts shall not be diminished, notwithstanding the provisions of KRS Chapters 600 to 645, the Juvenile Code.
     HFA (6, S. Westrom) - Retain original provisions and specify that secure detention for juveniles does not include any facility where adults are confined; specify timeframes for detention hearings; create new section of KRS Chapter 600 to maintain the contempt power of the court.
