AN ACT relating to insurance.
Create a new section of Subtitle 12 of KRS Chapter 304 to prohibit property and casualty insurers from using the fact of bodily injury as a result of domestic violence or abuse as the sole reason for rating and underwriting decisions, for refusing to insure or continue to insure, or for limiting the amount or kind of coverage; provide that if a policy of property coverage prohibits payment for intentional acts, the innocent co-insured shall not be denied payment if loss arose out of domestic violence or abuse and the perpetrator of the loss is criminally prosecuted for the act causing the loss.
