     AN ACT relating to safety and security at postsecondary education institutions.
     Create new sections of KRS Chapter 164 relating to safety and security at postsecondary education institutions; require each postsecondary education institution to maintain a daily log recording all crimes occurring on campus and make the log available for public inspection; require that campus security authorities immediately report a fire or threat of fire to the state fire marshal and the local authorities; require that campus security authorities immediately report each fire or threat of fire to the state fire marshal's office and the local authorities; effective September 1, 2000, and each year thereafter, require each postsecondary institution to report to the Council on Postsecondary Education policies and statistics related to campus safety and security; establish penalties for any person who violates the provisions of the Act; provide that the Act may be cited as the Michael Minger Act.

HB 322 - AMENDMENTS


     HCS/FN/LM - Retain original provisions except that postsecondary institutions shall not be required to waive sovereign immunity; clarify definitions of "campus" and "crime"; make technical corrections.
     HFA (1, J. Wayne) - Allow that any person may be civilly liable for any consequent injury or death resulting from violations of this Act; waive sovereign immunity for the postsecondary institution or its officers, agents or employees to the extent of the purchase of liability insurance or the establishment of a self-insurance fund by the postsecondary institution.
     HFA (2, J. Wayne) - Provide that any person may be civilly liable for any consequent injury or death resulting from violations of this Act.
