HB 334/LM (BR 1402) - J. Adams, J. Bruce, M. Cherry, B. Colter, J. Gray, B. Polston, K. Upchurch

     AN ACT relating to planning and zoning.
     Amend KRS 100.111 to include the definitions of "manufactured home" and "permanent foundation"; create a new section of KRS Chapter 100 to recognize the National Manufactured Home Construction and Safety Standards Act of 1974, and the HUD Code as the construction standard for manufactured housing, and prohibit local governments from adopting and enforcing zoning or other land-use regulations that discriminate against manufactured homes while not applying the provisions to mobile homes and also not affecting the adoption of residential housing regulations and ordinances; amend KRS 100.203 to add manufactured homes to the content of zoning regulations without affecting, modifying, or abolishing certain legal instruments.

HB 334 - AMENDMENTS


     HCS/LM - Retain original provisions of bill, except in Section 1 redefine "manufactured home" to mean only that as defined in KRS 227.550, and define "qualified manufactured home"; and prohibit local governments from discriminating against qualified manufactured homes, rather than just manufactured homes.
     HFA (1, J. Adams) - Provide that roof pitch be at a four foot rise rather than three; provide that local governments not differentiate rather than discriminate against qualified manufactured homes; and allow local governments to inspect manufactured homes for structural integrity once assembled on site.
     HFA (2, G. Lindsay) - Add and amend KRS 100.211 to require local legislative body approval of zoning map amendments before becoming final, rather than in the case of a tie vote, or automatically without majority vote to override planning commission's recommendation; repeal KRS 100.2111.
