HB 414 (BR 1681) - J. Gooch

     AN ACT relating to coal mine safety.
     Amend various sections of KRS Chapters 351 and 352 to include coal preparation plants, surface facilities, and overland coal belts in licensing, inspection, and safety requirements; change venue for license-revocation appeals to Franklin (from Fayette) Circuit Court; add definitions for the terms "reportable accident" and "serious accident"; classify all mines as "gassy"; require all miners to wear hardhats and hard-toe boots; require licensee to provide to the miner any safety equipment or clothing that the licensee requires beyond that required by law; require reportable accidents to be reported to the district office within 10 days; require a preshift examination board near the mine entrance describing the conditions of the mine; upon termination of a mine foreman, require the superintendent to replace him with a certified mine foreman; make numerous conforming amendments.

HB 414 - AMENDMENTS


     HCS - Retain original provisions of bill; amend KRS 352.020 to provide examples of fire resistant materials for use in permanent stoppings and overcasts; make various technical corrections; amend KRS 352.175 to delete new language requiring the licensee to provide special safety equipment or protective clothing beyond the requirements of KRS Chapters 351 and 352; and restore language previously deleted by HB 436 to KRS 352.400 that would require the licensee to provide special safety equipment or protective clothing required by new mine rules after April 9, 1996.
     HFA (1, B. Yonts) - Create a new section of KRS Chapter 353 to require that the Department of Mines and Minerals deny an application for a permit to drill a well if the proposed drilling might endanger the safety of underground coal miners.
