HB 415 (BR 1217) - J. Gooch

     AN ACT relating to insurance.
     Amend KRS 304.20-040 to define "declination," "decline," "agent"; add 3 grounds for cancellation of a motor vehicle insurance policy; prohibit cancellation or declination of motor vehicle insurance policy because of race, religion, nationality, ethnic group, sex, or marital status of applicant or insured or because another insurer previously declined to insure the applicant or insured; provide that when an insurer cancels or refuses to renew a motor vehicle liability insurance policy the notice to the insured must inform the insured that the insured may within 7 days, rather than 4 days, request the commissioner to review the insurer's action; specify actions commissioner may take for violation of this section; amend KRS 304.20-320 to clarify proof of notice; limit liability of commissioner and the insurer for furnishing reasons for cancellation or nonrenewal; amend KRS 304.20-340 to make technical change; amend KRS 304.20-042 to restrict application of statute to personal risks; amend KRS 304.20-310 to conform.

     HCA (1, J. Bruce) - Restrict liability limitation to the commissioner.
     HFA (1, J. Vincent) - Amend to remove liability limitation of the commissioner and the insurer for furnishing reasons for cancellation or nonrenewal.
     SFA (1, T. Buford) - Amend to create a new section in Subtitle 13 of KRS Chapter 304 to prohibit insurance companies writing automobile liability insurance in Kentucky from using the credit history, lack of credit history, or the educational level of an applicant, or a policyholder to determine a premium rate.
