HB 436 (BR 1682) - J. Gooch

     AN ACT relating to coal mining.
     Amend KRS 351.010 to make technical corrections to definitions; amend KRS 351.020 to change the word "state" to "Commonwealth"; amend KRS 351.030 to delete the requirement for the Department of Mines and Minerals to hold a hearing on any matter brought before it; and to make technical corrections; amend KRS 351.040 to require that any appeal from the Department of Mines and Minerals be brought to Circuit Court in the county where the subject matter is located; to delete the authority of the Circuit Court to grant relief from an unlawful or unreasonable order of the Department of Mines and Minerals; and make technical corrections to conform; amend KRS 351.103 to include reference to a certified miner; amend KRS 351.105 to delete the requirement for the commissioner of the Department of Mines and Minerals to call an organizational meeting after new members are installed; and make technical corrections to conform; amend KRS 351.107 to delete the requirement that the Mining Board determine whether a training program for shotfirers is sufficiently available to the workforce and an effective date for the application of KRS 351.107; make technical corrections to conform; amend KRS 351.108 to reference mine certificates issued by the commissioner of the Department of Mines and Minerals; amend KRS 351.160 to change the word "state" to "Commonwealth"; amend KRS 351.192 to delete provisions that do not require a person that performs mine rescue planning and recovery operations to participate in an investigation of a mine rescue operation; amend KRS 352.140 to change department to commissioner; amend 352.220 to delete reference to animals; to delete reference to a dates for the application of the section; and make technical changes to conform; amend KRS 352.230 to delete references to date for application of the section and to make technical changes to conform; amend KRS 352.260 to refer to a certified mine foreman; delete references to a date for application of the subsection and make technical corrections; amend KRS 352.290 to delete reference to an indelible pencil; amend KRS 352.350 to change reference from an operator of a mine to a licensee of a mine and make technical corrections; amend KRS 352.400 to delete the requirement that a licensee of a mine provide all equipment and clothing to satisfy a change in mine rules; amend 352.430 to include a departmental attorney among those who may represent the Commonwealth and make technical corrections; amend numerous sections of KRS Chapters 351 and 352 to make technical corrections; repeal KRS 351.128 and KRS 351.195.

HB 436 - AMENDMENTS


     HCS - Retain original provisions of bill; restore original language of statute to allow appeals to decisions made by the Department of Mines and Minerals to be brought to the Circuit Court in the county in which the mine is located; restore original language to allow land surveyors to certify map correctness; and make additional technical corrections.
     HFA (1, J. Gooch) - Restore authority of Circuit Court to grant relief from orders of the Department of Mines and Minerals. Make technical corrections.
