AN ACT relating to education and declaring an emergency.
Create new sections of KRS Chapter 156 to create a P-16 Commission to advise the legislature on a seamless system of education, and to specify requirements for a local personnel evaluation system for certified personnel, including the performance areas to be assessed; create a new section of KRS Chapter 160 to require each local board of education to adopt a formal recruitment and employment plan to attract a well-trained, diverse staff, and specify the minimum components, including training for various educators; create new sections of KRS Chapter 161 to require the development of a statewide, multidimensional recruitment and information plan to encourage persons to enter the teaching profession, including early recruitment programs for middle and high school students, reconstitute the Education Professional Standards Board (EPSB) as an independent agency with nineteen members; create the position of executive director of the EPSB and describe duties; charge the EPSB to determine preparation of current teachers for teaching in their assignments, particularly in the middle grades and to set forth corrective actions; require the board to define out-of-field teaching set a time at which districts will have a financial penalty for assigning teachers out-of-field; describe the ranking of teachers as previously described in KRS 157.390; add provision that classroom teachers who receive a Rank II or Rank I September 15, 2003 will receive salary associated with the rank change unless the rank program was in an education administrative program which requires that if the teacher has not taken a related position in three years, the salary benefit will be rescinded; describe the minority scholarship program and permit out-of-state persons to be eligible; create new sections of KRS Chapter 164 to describe requirements for participation in the Excellence Trust Funds relating to teacher preparation, and provide for tuition-free course work for supervising teachers of student teachers; amend KRS 12.020 to give autonomy to the EPSB, effective September 1, 2000; amend KRS 12.023 to attach the EPSB to the Governor's Office for administrative purposes only; move employees from the KRS Chapter 18A personnel system to the EPSB agency, effective September 1, 2000; amend KRS 156.095 relating to professional development to require school councils to use 50% of the state funds allotted to them for subject matter knowledge or improving teaching practices in the subject matter; require the Kentucky Department of Education to establish an electronic professional development consumer bulletin board and require the establishment of teacher academies in the core content areas; amend KRS 156.101 to require instructional leaders to have six (6) clock hours of training in diversity and equity issues; amend KRS 156.111 to require superintendent's training in personnel management; amend KRS 157.390 to conform and permit additional salary compensation above the base single salary schedule to address shortages, working in difficult assignments and serving as a mentor or teaching partner; amend KRS 158.070 to specify the conditions for flexible professional development days; amend KRS 160.345 to require school councils to have training in personnel recruitment, interviewing, and observation before hiring a principal; amend KRS 160.180 to require local board members to have personnel training relating to the hiring and evaluation of a superintendent; amend KRS 160.380 to increase notice of certified vacancies; amend KRS 161.010 to add definitions; amend KRS 161.020 to clarify language; amend KRS 161.028 relating to the duties of the EPSB to elaborate on standards for teacher preparation institutions; require annual review of diversity in teacher preparation and require solicitation of the development of one or more nontraditional teacher preparation programs; amend 161.030 to add an option for retired teachers who qualify to serve as resource teachers for interns; amend KRS 161.042 relating to student teaching to require the board to promulgate administrative regulations defining the professional requirements and general duties of supervising teachers and requirements for local school district and schools; amend KRS 161.048 relating to alternative certification to allow for the development of alternative plans for principals and superintendents; amend KRS 161.049, KRS 161.100, KRS 161.126 and KRS 161.157 to conform; amend KRS 161.220 to state that EPSB employees are included in KTRS; amend KRS 161.165 relating to minority recruitment; define former and new EPSB; terminate terms of former members of the EPSB at the effective date of the Act but describe transition and option for reappointment; provide that the executive secretary of the former board become the acting executive secretary and describe functions and how employees shall be transferred from the Kentucky Department of Education; describe transfers of equipment, records, resources, and other materials of former board; direct the state budget director and the Governor's Office of Policy and Management to make appropriate funds transfers and allocations no later than September 1, 2000; require the EPSB to conduct a study of student teaching and field experiences; require a feasibility study of using retired teachers on an annual basis to serve as full-time teachers and not jeopardize their retirement annuities; require a report by October 15, 2001; require the EPSB to contract with an independent third party for a comprehensive review of the teacher internship program and make recommendations prior to the regular session of the General Assembly; require the EPSB to consider options for monetary and time incentives as well as unique program designs that can increase the number of qualified candidates for the school principalship; declare an EMERGENCY.
HB 437 - AMENDMENTS
HCS/FN - Retain original provisions of the bill with the following changes: require the Kentucky Department of Education rather than the Education Professional Standards Board to develop a statewide recruitment plan to encourage persons into teaching; change membership of the Education Professional Standards to require eight teachers and two administrators instead of at least seven teachers and at least two administrators; require that the Education Professional Standards Board provide options from which teachers may choose to document their content preparedness which shall include documentation of successful completion of professional development or course work since initial certification, performance on competency tests or performance assessments, results of classroom evaluations by other teachers in the content areas; outstanding performance by students; distinguished achievement or recognition in the content area; change date from 2000 to 2001 for the Department of Education to establish teacher academies in all of the core disciplines; delete section that would require rescinding a teacher's salary benefit associated with rank change for those teachers who earn Rank II or Rank I in education administration and do not assume an administrative position within three years; require teaching of classroom management as an essential component in teacher preparation; delete the study of using retired teachers in the classroom; require a study of ranking; delete the requirement that 50% of professional development funds allotted to school councils be used to improve subject matter content or teaching of the content; ensure that teachers suffer no salary penalty for being assigned to teach out-of-field; require the Kentucky State Police to develop direct billing for criminal checks; amend KRS 18A.115 to allow the Kentucky Board of Education to determine exempt employees and to set their compensation; leave all employees of the Education Professional Standards Board under the KRS Chapter 18A personnel system, except for those policy level employees who shall be determined to be exempt from classified service by the Education Professional Standards Board; add an option for requesting approval from the Education Professional Standards Board for an alternative program between the Department of Education, local school district, or group of districts and a postsecondary education institution; and make technical corrections to conform.
HCA (1, H. Moberly) - Require principal to evaluate middle school teachers' subject matter preparation, by 2002, based on standards the board establishes; require principal to assist teachers needing additional subject matter preparation; allow teachers until 2004 to correct deficiencies; provide that a teacher shall not receive a new assignment to teach a content area unless he or she has a major, minor, or equivalent qualification in the subject area.
HCA (2, D. Butler) - Require a local school district superintendent to post a vacancy as soon as he or she is aware that a vacancy will occur rather than after the vacancy occurs.
HFA (1, K. Stein) - Delete references to "additional compensation" and replace with "supplement" in Section 18 of the bill; add language to make the supplements one-time only; and add language that supplements shall be for services rendered in the common schools.
HFA (2, M. Marzian) - Add a provision to exempt from the provisions of subsection (1)(a), (1)(b), and (1)(e) of section 7 of the Act any teacher who on July 1, 2001, holds a valid teaching certificate that authorizes the teacher to teach in kindergarten through the eighth grade.
HFA (3, M. Marzian) - Add provision to exempt any teacher who on July 1, 2002, holds a valid teaching certificate authorizing the teacher to teach kindergarten through eighth grade from the provisions of subsection (1)(a), (1)(b), and (1)(e) of Section 7 of this Act.
HFA (4, S. Johns) - Retain original provision except change the membership of the Education Professional Standards Board from nineteen members to twenty three, including twelve teachers instead of eight.
HFA (5, C. Miller) - Retain original provisions of the bill, with the following changes: require middle school principals rather than the Education Professional Standards Board to design procedures to evaluate the subject matter and teaching preparedness of middle school teachers; require principals to report results to the Education Professional Standards Board; delete the requirement that the Education Professional Standards Board promulgate administrative regulations that identify the options a teacher may request to be used to determine his or her level of preparation; and permit a teacher to appeal a negative determination of preparedness through the use of a variety of specified options.
HFA (6, K. Stein) - Delete references to "additional compensation" and replace with "supplement" in Section 18 of the bill; add language to make the supplements one-time only; and add language that supplements shall be for services rendered in the common schools.
HFA (7, K. Bratcher) - Prohibit the involuntary transfer of a teacher member of the school-based decision making council.
HFA (8, H. Moberly) - Retain original provisions, except delete all language related to evaluation of middle school teachers' subject matter preparation; revise language relating to the professional growth fund and require that priority for funds be given to middle school teachers with certificates to teach in Grades K-8; and add a section to require the Education Professional Standards Board to study the issues relating to the preparation of teachers in their subject matter areas and make a report with recommendations to the Interim Joint Committee on Education by August 2001.
SFA (1, B. Jackson) - Retain original provisions, except add new language to provide that a university may request approval from the Education Professional Standards Board for an alternative certification program that permits a teacher or administrator candidate to be employed and to serve an internship and participate in assessments concurrently with enrollment in a postbaccalaureate program in teacher preparation or administrator preparation.
