     AN ACT relating to retirement.
     Amend KRS 21.400 to allow a judge to retire as a "Senior Status Special Judge" if his or her combined total years of service credit and age equal 75; require an election to be made within 30 days of retirement, calculate retirement based on 5% of final compensation based on the number of years of judicial service and 2.75% of final compensation based on number of years of non-judicial service; require a "Senior Status Special Judge" to serve as a special judge when appointed by the Chief Justice for a maximum of 90 days a year for a 5 year period without additional compensation; give the Chief Justice discretion to appoint a "Senior Status Special Judge" for more than 90 days in a given year, and then credit the time served in a subsequent year.

HB 439 - AMENDMENTS


     HCS/AA - Make the creation of Senior Status Special Judges a pilot program which sunsets July 1, 2007.
     HFA (1, B. Heleringer) - Retain original provisions of the committee substitute and clarify that a judge who is defeated for reelection cannot serve as a Senior Status Special Judge in the jurisdiction where the judge was defeated.
     HFA (2, J. Barrows) - Provide that any judge who was in office on January 1, 1998, shall be eligible for Senior Judge status.
