AN ACT relating to motor vehicle titles.
Amend KRS 186A.520, regarding motor vehicle salvage titles, to exempt vehicles damaged solely by hail that are still road worthy from requirements for salvage title; amend KRS 186A.530 to conform.
HB 443 - AMENDMENTS
HCS/LM - Insert a new Section 1 in the bill to create a new section of KRS Chapter 186A, relating to the automated motor vehicle registration system (AVIS), to provide that the owner of a motor vehicle damaged solely by hail must have the existing title to the vehicle branded for hail damage, but the owner is not required to obtain a salvage title on the vehicle, if the vehicle can be legally operated on the highway, the actual cost or estimate to repair the hail damage exceeds 75% of the vehicle's retail value, and if the owner intends to retain ownership of the vehicle; provide for the person to submit to the sheriff a statement from their insurance company attesting that the vehicle's damage exceeds 75% of the vehicle value and is solely the result of hail damage and have the vehicle inspected by the sheriff and submit inspection information to the county clerk; provide for clerk to stamp the owner's existing paper title "hail damage" and to enter information on branding the title into AVIS; provide for title to always carry the "hail damage" brand; renumber existing Section 1 of the bill as Section 2 and amend the provisions to delete paragraph (b) of subsection (1); renumber existing Section 2 of the bill as Section 3 and make conforming amendment.
