AN ACT relating to control of fraud and abuse in medical assistance programs under Title XIX of the Federal Social Security Act.
Create a new section of KRS Chapter 205 to permit the Attorney General to commence a civil action in any court against a provider that has been indicted for an offense against the Kentucky Medical Assistance Program to enjoin the violation; prohibit a provider who has been indicted from conveying, transferring, or otherwise disposing of property relating to a violation or property of equivalent value; require any injunction or restraining order to be granted without bond; require the court to proceed as soon as practicable to the hearing and determination of the action; permit the court to enter a restraining order or a writ of prohibition or take any action to prevent continuing injury to the Commonwealth or other person; require that the proceedings be governed by the Kentucky Rules of Criminal Procedure and the Kentucky Rules of Evidence.
