     AN ACT relating to the provision of telecommunication services by municipalities and municipal utilities.
     Amend KRS 278.010 to delete (3)(e) and to define "municipal utility" as a utility owned, operated, and controlled directly or indirectly by a municipality, or by a corporation, partnership, joint venture, interlocal agreement, board, commission, or other entity the directors of which are appointed, in whole or part, by the municipality; define "telephone utility" and "municipality"; provide that a municipality or municipal utility providing or planning to provide telecommunications services shall be subject to regulation by the Public Service Commission of Kentucky in the same manner as other nonmunicipal providers of telecommunications services and shall be considered a "telephone utility"; specify that the Public Service Commission shall have jurisdiction over municipalities and municipal utilities providing telecommunications services to ensure fair competition; allow the commission to promulgate administrative regulations pursuant to KRS Chapter 13A.

HB 477 - AMENDMENTS


     HCS/LM - Create new section of KRS Chapter 96 to subject the telecommunications portion of a municipal utility to regulation by the Public Service Commission; amend KRS Chapter 96.170 to allow a city of the third class to provide telecommunication service and to require that the telecommunication service be subject to regulation of the Public Service Commission; amend KRS Chapter 96.190 to allow a city of the fourth class to provide telecommunication service and to require that the telecommunication service be subject to regulation by the Public Service Commission; amend KRS Chapter 96.520 to allow a city of the second, third, fourth fifth or sixth class that provides telecommunication service be subject to regulation by the Public Service Commission; amend KRS Chapter 278.010 to remove a municipal utility that provides telephone service from the exemptions that apply to other utility services.
     HCA (1, C. Geveden) - Amend Section 1 to allow any city to provide telecommunications service; amend Sections 2 to 4 to provide that only telephone service will be regulated by the Public Service Commission.
     HFA (1, C. Geveden) - Technical correction in Section 1 to change the reference to Section 4 to Section 5.
