     AN ACT relating to teachers' retirement.
     Create a new section of KRS Chapter 156 to define "critical shortage area" as a lack of certified teachers in particular subject matters, in grade levels, or in geographic locations as determined by the commissioner of education; require the Kentucky Board of Education to promulgate administrative regulations to implement the hiring of teachers in critical shortage areas; amend KRS 161.605 to provide that a retired member may return to work in a critical shortage area without loss of retirement benefits; require the employer and the employee to contribute annually to the retirement system on the compensation paid to the retired member at rates determined by the retirement system actuary.

HB 519 - AMENDMENTS


     HCS/AA - Retain original provisions of Section 1 creating a new section of KRS Chapter 156 and add the requirement that the commissioner report the reemployment of members to the KTRS; in Section 2, amending KRS 161.605, permit the reemployment of retired members in critical shortage areas upon the certification of the commissioner of education to the KTRS of the unavailability of qualified applicants; permit a local school district to employ retired members as full-time employees during a school year, in numbers not to exceed the greater of either two members or 1% of the total active members of the retirement system in the district; and permit retired members to hold full-time positions on a one-year contract in a district from which the retiree did not retire after a three month absence, or in a district in which the retiree did retire after a one year absence.
     HFA (1, C. Miller) - Delete the provision that part-time teachers can return to teaching in critical shortage areas.
