AN ACT relating to oil and gas.
Amend KRS 353.620 to allow the Department of Mines and Minerals to issue a permit for an oil or gas well to be closer to a boundary than prescribed in KRS 353.610; amend KRS 353.630 to allow the department to require the development of pooled acreage as a single leasehold estate; amend KRS 353.640 to notify owners of a portion of an oil or gas interest if it is proposed to be pooled with another tract.
HB 616 - AMENDMENTS
SCA (1, P. Herron Jr) - Amend KRS 353.630 relating to pooling of oil and gas interests to specify that where the Department of Mines and Minerals finds that the requirements of subsections of the section have been met the department shall order the pooling of all oil and gas interests; amend KRS 353.640 to require the operator to provide a list to the department of all persons reasonably known to own an oil or gas interest in any tract proposed to be pooled in an application for a pooling order; require the department to provide notice to all persons reasonably known to own an oil or gas interest in any tract proposed to be pooled and wait for a hearing before making a pooling order; where unknown owners or nonlocatable owners exist, require publication of notice that an application for a pooling order has been filed in the newspaper; specify information to be included in the newspaper notice.
