AN ACT relating to surface mining.
Create a new section of KRS Chapter 351 to exempt landowner who removes coal incidental to construction from obtaining mining permit and mining license, if coal is 2,000 tons or less and is donated to charity; require Department of Mines and Mineral to provide advice and technical assistance to landowner; amend KRS 350.010 to conform.
HB 642 - AMENDMENTS
HCS - Amend HB 642 to require organizations receiving donated coal to be tax exempt under Section 501(c)(3) of the Internal Revenue Code; require a landowner to give notice to the department prior to coal removal; and make technical corrections.
