AN ACT relating to consumer protection.
Create various new sections in KRS Chapter 376, Kentucky's Consumer Protection Act, to regulate deceptive promotional advertising of prizes and sweepstakes.
HB 67 - AMENDMENTS
HCS - Retain original provisions of the bill with the following changes; exempt advertisements, mailings and written communications by a retail business; and makes intentional violation of this Act a Class D felony.
HFA (1, S. Nunn) - Retain provisions as amended in HCS, but add new subsection to exempt advertisements, mailings, or other written communications of political parties, labor unions or religious institutions.
HFA (2, S. Westrom) - Amend language to restrict to promotional offers mentioning prizes.
SCS - Retain original provisions of HB 67/GA with amendments to definition of promotional offer and prize, specify point size and placement for odds disclosures, clarify exemption for retail businesses, limit treble damages recovery to violations of section 4, place criminal provision into penalty section of KRS Chapter 367, and make technical revisions.
SFA (1, K. Stine) - Amend to remove provisions relating to type size.
SFA (2, T. Buford) - Create a new section of KRS Chapter 367 to exempt certain sales transactions from application of provisions of the Act relating to deceptive promotional advertising of prizes and sweepstakes.
SFA (3, T. Buford) - Create a new section of KRS Chapter 367 to exempt certain sales transactions from application of provisions of the Act relating to deceptive promotional advertising of prizes and sweepstakes.
