AN ACT relating to the registration of motor vehicles in counties required to have a vehicle emission control program.
Create a new section of KRS Chapter 186, relating to the registration of motor vehicles, to prohibit a vehicle from being registered in a county that is required to have a vehicle emission control program unless the vehicle has successfully passed the VET or been issued an exemption certificate; amend KRS 186A.040, relating to information to be included in the AVIS database, to require the Department of Vehicle Regulation to provide the Department of Information Systems information on vehicle emissions testing in order for the information to be included in the AVIS database; amend KRS 224.20-720, relating to issuing VET compliance and exemption certificates, to require the independent contractor in a county that is required to have emission testing to electronically link each testing station and to transmit the test results to the Transportation Cabinet; provide for the information to be developed into a subset of AVIS for use by each county clerk; require the county clerk to verify a vehicle has successfully passed the VET or been issued an exemption certificate before registering the vehicle; amend KRS 224.20-765, relating to penalties for vehicle emission control violations, to prohibit a person from being guilty of a criminal offense for failure to pass the VET and remove the penalty from the criminal court system.
