HB 709 (BR 1224) - C. Belcher

     AN ACT relating to consumer protection.
     Amend KRS 304.2-430 to allow the commissioner of insurance to retain ten percent of aggregate fines collected to establish and maintain a program to educate consumers on insurance products, insurance practices, and insurance fraud; amend KRS 304.2-165 on written complaints to make the statute applicable to entities or individuals engaged in the business of insurance; create a new section of Subtitle 14 of KRS Chapter 304 to establish a 2 year statute of limitations on an action or request for reimbursement for any overpayment pursuant to an insurance contract; create a new section of Subtitle 9 of KRS Chapter 304 to designate four grounds upon which the commissioner may suspend or place conditions on the license of an insurance agent; provide that an agent license or appointment may be based upon the application and any other information pertaining to the applicant available to the department of insurance; provide that any person aggrieved by an order under this section may file an application for a hearing within 60 days of the date of the order.

HB 709 - AMENDMENTS


     HCA (1, C. Belcher) - Amend to remove the language that allowed the department of insurance to retain 10% of fines collected to maintain a program to educate consumers.
     HFA (1, C. Belcher) - Change provision that requires an action for reimbursement for overpayment to be brought within two years to apply to overpayment of a health insurance claim.
     HFA (2, J. Gray) - Add two sections of KRS 311.530 to 311.620 to require that physician profiles setting out the education, training, and board certifications of physicians be developed; include in each profile information as to the hospitals in which the doctor has privileges, the doctor's writings published, and pending or actual malpractice suits against the physician; require the board to transmit information to the public at no charge; require disclosure that a settlement does not necessarily reflect negatively on the physician.
