HB 8/FN (BR 88) - H. Collins, J. Arnold Jr., B. Yonts
AN ACT relating to fines and declaring an emergency.
Amend KRS 189.990(2)(a) to reinstate maximum fine of five hundred dollars ($500) for overweight violations; create a new section of KRS Chapter 189 to require a refund be paid to any person who was cited between July 15, 1998 and the effective date of this Act in excess of $500 for violating KRS 189.990(2)(a); establish procedure for applying for a refund through the State Treasurer.
HB 8 - AMENDMENTS
HCA (1, H. Moberly) - Amend Section 1 to restructure fine charged for overweight violations when load exceeds five thousand pounds; delete Section 2 in its entirety that proposed to offer a rebate of fines issued between July 15, 1998, and July 15, 2000; renumber sections accordingly.
SCS/FN/LM - Retain original provisions of the bill with the following additions: amend Section 1 to delete subsection (29), which sets penalties for violations of KRS 189.285 and set fines for violation of KRS 189.285 at $20 to $100; add a new Section 2 to amend KRS 189.285 to delete the requirement for health insurance for motorcyclists who wish to not wear a helmet; add Section 3 to repeal KRS 186.865 to conform; renumber subsequent sections.
SCA (1/Title, V. Moore) - Make title amendment to read "AN ACT relating to traffic regulations and declaring an emergency."
CCR - The Conference Committee could not reach an agreement and requested a Free Conference Committee to be appointed.
FCCR (Majority Report) - The Free Conference Committee adopted the GA version of HB 8 with one amendment as follows: amend subsection (2) of Section 1 of the GA version of HB 8 by reducing the maximum overweight fine from $1,000 to $500.
