AN ACT relating to industrial hemp.
Create new sections of KRS Chapter 260 to allow the commercial production of industrial hemp as an agricultural product in Kentucky; direct the Department of Agriculture to oversee the licensure and enforcement of industrial hemp growers and production; control the supply of hemp seed and encourage the development of a hemp seed industry in Kentucky; create an industrial hemp research and marketing program to be administered by the Department of Agriculture working cooperatively with a Kentucky land grant university's agricultural research program; use the Council on Postsecondary Education to select the site of the program; establish an "industrial hemp program fund" to offset the costs of this marketing and research; implement a licensure fee for industrial hemp growers.
HB 855 - AMENDMENTS
HCS - Retain original provisions of bill except amend to allow all universities with Agriculture Departments to apply and be considered by the Council on Post Secondary Education for the location of the industrial hemp research program; require the Department of Agriculture to deny a license to grow industrial hemp to any applicant who has been convicted of growing marijuana; and technical corrections.
HFA (1, M. Treesh) - Retain provisions that allow research on industrial hemp; delete provisions that would allow growing, producing, handling, possessing, and engaging in commerce in industrial hemp in the Commonwealth under the Act; delete licensing provisions, enforcement provisions, and seed supplier provisions of the Department of Agriculture; retain provision allowing a selected university to carry out industrial hemp research.
HFA (2, J. Barrows) - Retain all original provisions of the bill; amend section that allows a selected university to carry out industrial hemp research and allows the Council on Postsecondary Education to select more than one university for the industrial hemp programs; amends the waiver of the industrial hemp university research programs to provide that the state shall separately license the industrial hemp research programs rather than extending a total waiver and adds a new section of non-codified language which delays the effective date for the industrial hemp licensure framework for individual growers, producers and handlers until July 15, 2002 but allows a normal effective date for the university industrial hemp research programs.
HFA (3, J. Barrows) - Retain provisions that allow research on industrial hemp; delete provisions that would allow growing, producing, handling, and possessing industrial hemp grown in Kentucky under the Act; delete licensing, enforcement and seed supplier provisions and the provision that allows for the promulgation of administrative regulations relating to industrial hemp under the Department of Agriculture; amend section that allows a selected university to carry out industrial hemp research and allows the Council on Postsecondary Education to select more than one university for the program; and adds new section of KRS 260 which directs the state of Kentucky to adopt the current Federal rules and regulations regarding industrial hemp and any subsequent changes.
HFA (4, J. Coleman) - Add amendments exempting industrial hemp production from taxation under KRS 138.070; include prior conviction for marijuana possession or trafficking as a disqualification for an industrial hemp license; permit peace officers as well as the department to enforce the provisions of the law; permit entry on premises where industrial hemp is grown or cultivated at any time; require administrative regulations to be promulgated regarding uniform procedures for THC content testing; require THC content testing to be at departmental expense; permit department to authorize others to do THC testing; provide for revocation of industrial hemp license if person holding license is convicted of disqualifying offense for issuance of a license.
