AN ACT relating to health insurance.
Amend KRS 304.17A-005, 304.17A-095, 304.17A-210, and 304.17A-250 to delete definition and references to "guaranteed acceptance plan", and references to standard health benefit plan; amend KRS 304.17A-230 to describe the standard of a preexisting condition; amend KRS 304.17A-260 to grant amnesty to insurers who ceased doing business in Kentucky; amend KRS 304.17A-510, 304.17A-525, and 304.17A-550 to include managed cared plans in activities required of other insurers; create new sections of subtitle 17A of KRS Chapter 304 to define terms; create the Kentucky Health Insurance Program (program); establish eligibility requirements, including income guidelines; require participation by insurers; establish that funds for the program will be generated from several sources, but that the major funding will come from the "settlement agreement" between the Commonwealth and Philip Morris Inc.; establish the powers and duties of the board to oversee administration of the program; establish the duties and responsibilities of the administrator of the health plan developed by the board of the program; establish the procedures for the assessment of insurers; establish plan coverage, exclusions, rates, and deductibles; authorize the commissioner to promulgate administrative regulations; amend KRS 304.17A-160, 304.17A-0952, 304.17A-290, 304.17A-320, 304.17A-150, and 304.17A-290 to conform; repeal KRS 304.17A.080, 304.17A-210, 304.17A-280, 304.17A-400, 304.17A-410, 304.17A-420, 304.17A-430, 304.17A-440, 304.17A-450, 304.17A-460, 304.17A-470, and 304.17A-480.
