SB 109 (BR 1630) - L. Saunders

     AN ACT relating to complaints against police officers.
     Amend KRS 15.520 to require complaints against police officers to be timely and to forbid third party complaints; require audio recording and the presence of counsel at interrogations of officers; and require that failure to follow rules and due process shall result in dismissal of complaints against an officer.

SB 109 - AMENDMENTS


     SCA (1, K. Stine) - Permit a complaint to be filed against a peace officer within the later of 60 days after the alleged abuse or 60 days after any criminal case arising out of the alleged abuse; prohibit third party complaints against peace officers except by a parent or guardian of a minor child; a guardian of a person under a disability, or a personal representative of a deceased person.
     SFA (2, L. Saunders) - Require that a complaint against a police officer be filed no later than the later of 6 months after the event or 60 days after the conclusion of any criminal case arising out of the event; delete the prohibition against third party complaints; delete the requirement that a police officer receive nonredacted copies of any sworn statements or affidavits to be considered; require that any denial of the police officer's rights results in the exclusion of any evidence obtained from the denial.
     SFA (3, L. Saunders) - Delete the provision which requires that an accused police officer shall have the right and opportunity to obtain and be represented by counsel during an administrative proceeding.
     SFA (4, L. Saunders) - Deleting the right of police officers to have counsel present during interrogation and the right to consult with counsel during interrogation.
