SB 111/FN (BR 1650) - E. Scorsone

     AN ACT relating to disclosure requirements for nursing facilities.
     Create a new section of KRS 216 to require a long-term care facility that claims to provide special care for persons with Alzheimer's disease or other related disorders to disclose in its advertisements or in a separate document those services that distinguish the care as being especially applicable to persons with Alzheimer's disease or other related disorders; require the long-term care facility to provide a copy of the advertisements or documents to any person requesting information about the facility's services for persons with Alzheimer's disease or other related disorders, and to post a copy of advertisements or other separate documents; require the Division for Licensing and Regulation to examine the advertisements or other separate documents related to special services for persons with Alzheimer's disease or other related disorders; and establish the content that must be included on the advertisements or other separate documents.

SB 111 - AMENDMENTS


     SCA (1, E. Scorsone) - Retain original provisions; amend to require long-term care facilities to display instead of post a copy of advertisements or separate documents disclosing services provided that are especially applicable to, or suitable for, persons with Alzheimer's disease or related disorders; and delete the requirement that the Division of Licensing and Regulation exam all advertisements or documents as a part of the license renewal process.
     SFA (2, J. Rose) - Require long-term care facility that offers special services related to Alzheimer's to maintain manual with detailed information about facility services; delete requirement that facilities include detailed information in advertisements; require advertisements to contain statement that written information is available relating to services and policies is at the facility upon request; require facility to post statement that written information is available relating to services and policies is at the facility upon request.
     SFA (3, E. Scorsone) - Retain original provisions; delete the requirement that staffing patterns be included in the content required for advertisements or other separate documents of any long-term care facility that claims to provide special care for persons with a medical diagnosis of Alzheimer's disease or other related disorders.
     HCS/FN - Retain original provisions; require long-term care facilities that claim to provide special care for persons with a medical diagnosis of Alzheimer's disease or related disorders to provide a copy of any information contained in the required manual describing the services and programs to any person upon request at no cost and make technical correction.
