SB 116 (BR 1733) - M. Long

     AN ACT relating to victims of crime.
     Amend KRS 196.280 to provide notice to the public when an incarcerated person is released from a penitentiary; create a new section of KRS Chapter 411 to permit a crime stalking victim to sue the stalker; amend KRS 431.064 to facilitate the entry of conditions of a defendant's release into the Law Information Network of Kentucky; amend KRS 438.250 to require that a crime victim receive the results of certain HIV tests performed on the person who committed the crime; amend KRS 510.320 to require that a crime victim receive the results of certain HIV tests performed on the person who committed the crime; amend KRS 439.510 to require that information obtained by probation and parole be divulged to the person being supervised, the Commonwealth's Attorney, and the victim.

SB 116 - AMENDMENTS


     SCS - Increase community notification when an incarcerated person escapes or fails to return to the place of incarceration; permit a person to sue a stalker for civil damages even when the stalker has not been convicted of the crime of stalking; delete the provision granting the victim access to the presentence investigation report.
     HCS - Retain original provisions and amend to clarify language relating to civil suits for stalking.
