SB 13/CI (BR 27) - J. Westwood
AN ACT relating to crimes and punishments.
Establish the crime of fleeing or evading a police officer in the second degree.
SB 13 - AMENDMENTS
SCS/CI - Include a requirement that the police officer "has an articulable and reasonable suspicion that a crime has been committed" before stopping a person and delete property damage as an element of the crime.
SFA (1, J. Westwood) - Technical correction, remove reference to damage to property.
SFA (2, D. Karem) - Replace the language "an articulable reasonable suspicion" to "probable cause to believe."
SFA (3, D. Williams) - Delete damaging property while fleeing on foot as an element of the offense; specify that fleeing on foot is a Class B misdemeanor unless a person receives physical injury in which case it is a Class A misdemeanor; retain Class A misdemeanor for fleeing in a motor vehicle.
