SB 149 (BR 1147) - R. Roeding, M. Long, B. Jackson, G. Johnson

     AN ACT relating to government contracts.
     Create new sections of KRS Chapter 45A and amend several sections of Chapter 45A to provide for legislative intent; exempt from routine review Memoranda of Agreement (MOA's) between state agencies and universities or colleges, but require filing of the agreement with the Government Contract Review Committee not more than thirty (30) days after the effective date; require routine review of MOA's filed more than thirty (30) days after the effective date; provide for ongoing jurisdiction and agency participation; allow the committee to receive testimony under oath and establish the procedures; delete a conflicting provision of the statutes relating to competitive bids for personal service contracts; establish the definition of emergency condition; remove the provision exempting agreements between state agencies and state universities or colleges from the definition of MOA; require request for proposals for personal service contracts over $10,000; require three quotes, if feasible, for personal service contracts of $10,000 and under; require documentation of unfeasibility to the secretary of the Finance and Administration Cabinet; allow review of the determination of unfeasibility; specify that personal service contracts and MOA's shall not be paid until after completion of the review process by the committee; specify that, in the event of a governmental emergency, the secretary of the Finance and Administration Cabinet and (in certain circumstances) the agency head must make a determination that there is a governmental emergency and communicate those reasons to the committee.

SB 149 - AMENDMENTS


     SFA (1, R. Roeding) - Delete requirement of annual reporting on personal service contracts and memoranda of agreement to the Government Contract Review Committee.
     HCS - Delete requirement that personal service contracts under $10,000 require at least 3 quotes if feasible or a letter stating the unfeasibility.
     HFA (1, J. Adams) - Create new section of KRS Chapter 45A to exempt agreements solely funded by federal pass through funds from regular review by the LRC Government Contract Review Committee but require copies of all documents to be filed with the Committee 30 days after their effective dates, require the Committee to examine all agreements filed with the Committee more than 30 days after their effective date, and permit the Committee to periodically review agreements as prescribed.
     HFA (2, J. Jenkins) - Require 72 hours written notice be given to specified witnesses and clarify that the transcript of the meeting shall be admissible in court in accordance with the rules of evidence.
     HFA (3, J. Jenkins) - Delete Section 3 relating to the requirement of testimony being given under oath to the committee and the official recording of the testimony.
