SB 152 (BR 46) - C. Borders
AN ACT relating to gambling related activities.
Amend KRS 230.380 to apply the same process of local notification, veto, and taxation to the siting of a noncontiguous race track facility as is now provided for a simulcast facility.
SB 152 - AMENDMENTS
SFA (1, C. Borders) - Apply the 1% local economic development tax to a noncontiguous race track facility being established in a county that does not have pari-mutuel wagering, unless the local governing body and the establishing track agree in writing to the contrary.
HCS - Retain provisions of original bill; add various new sections to amend KRS 138.510 to provide a tax exemption on live racing, effective January 1,2001, at a host track in this state holding a one day international horse racing event; permit the exemption to continue if a succeeding event is held within three years of the previously held event; exempt a noncontiguous track facility approved on or after January 1, 1999 from the 3% excise tax on wagering if it has an annual handle for live racing of $250,000 or less; allow the noncontiguous facility to retain the money; create a new section of KRS Chapter 230 to allow the Kentucky Racing Health and Welfare Fund, Inc., to create and fund the Kentucky Race Track Retirement Plan to benefit certain racing personnel; establish limitations on the amount to fund the plan; place restrictions on how plan funds may be invested; add a new section of KRS Chapter 372 to clarify that it is not the intent of the General Assembly to apply the provision of the chapter to losses occurring through legalized gaming, and make the provision retroactive; amend KRS 230.230 to grant the chairman and executive director of the Racing Commission general authority over personnel matters for staff employed by the commission; vest racing commission security officers with full police powers; and amend KRS 15.380 to exempt racing security officers from certification requirements imposed on police officers.
HFA (1/Title, D. Butler) - Make title amendment.
HFA (2, D. Butler) - Retain original provisions, except eliminate the provision that makes retroactive application of the requirement that the terms and provisions of KRS Chapter 372 do not apply to betting, gaming, or wagering that has been authorized, permitted, or legalized.
HFA (3, D. Butler) - Delete language giving racing commissioners peace officer powers, and add language to clarify that the power of racing security officers is restricted to enforcing racing laws and protecting persons and property on licensed premises.
CCR - Cannot agree and request a Free Conference Committee.
FCCR (Majority Report) - Adopt the HCS for SB 152, adopt HFA1/TITLE, and HFA's 2 and 3, and delete language in Section 6 which would have made the Racing Commission security department a public police department.
