SB 21 (BR 353) - D. Adams, J. Pendleton
AN ACT relating to the Petroleum Storage Tank Environmental Assurance Fund.
Amend KRS 224.60-140, relating to the Petroleum Storage Tank Environmental Assurance Fund, to require that persons submitting requests for reimbursement from the fund certify by affidavit that all subcontractors and vendors have been paid, with the submission of a false affidavit as to payment being a separate crime as to each unpaid subcontractor or vendor.
SB 21 - AMENDMENTS
SCA (2, D. Adams) - Revise to include language allowing subcontractors and vendors to waive prior payment from the prime contractor if they waive their right to seek payment from the owner of site.
SFA (1, D. Kelly) - Amend to clarify that business entities as well as "persons" must comply with provisions; allow persons or business entities to seek reimbursement without having first paid subcontractors and vendors, if the subcontractors and vendors have waived their right to immediate payment.
HCA (1, H. Collins) - Amend SB 21 to give the Fund the authority to hold a person accountable for submitting misleading or false information when applying for reimbursement.
HFA (1, J. Lee) - Amend KRS 224.60-142 to extend the date by which petroleum storage tanks must be registered to July 15, 2002 from July 15, 2000.
