SB 218 (BR 1878) - D. Karem, D. Boswell, B. Bailey, T. Buford
AN ACT relating to child support.
Amend KRS 15.725, KRS 69.210, and KRS 205.712 to give statewide child support jurisdiction to county attorneys; amend KRS 154A.060 to require the Kentucky lottery corporation to forward a list of winners of lottery prizes of over $600 to county attorneys and to withhold lottery prizes of over $600 for child support arrearages; create new sections of KRS 205.712 to 205.800 to require uniform child support forms for all child support orders, require the Cabinet for Families and Children and the Revenue Cabinet to share information and responsibility for child support collections, and establish a program to help low-income noncustodial parents find employment; amend KRS 205.712 to require child support services to be available during nontraditional hours, change the arrearage limit for license denial from 1 year to 3 times a monthly payment, and require the Cabinet for Families and Children to publish a list and poster of obligors with arrearages; amend KRS 205.745 to permit the Cabinet for Families and Children to boot vehicles of child support obligors; amend KRS 205.755 to permit the Cabinet for Families and Children to use automated methods for child support collection and distribution; amend KRS 403.212 to require the State Treasurer to forward a list of persons receiving Tobacco Settlement Agreement funds; amend KRS 403.212 to permit courts to order grandparent support of the children of minor parents; amend KRS 405.470 require arrearages to accrue interest of 8%; amend KRS 403.160 to conform.
SB 218 - AMENDMENTS
SCS - Delete provisions giving statewide child support jurisdiction to county attorneys; require the suspension or revocation of a license or certification that has been issued to a person who is 6 months in arrears in the payment of child support; make technical changes.
SCA (1, D. Karem) - Retain original provisions except require Cabinet for Families and Children to submit list of delinquent child support obligors to the Kentucky Lottery Corporation on a monthly basis; require Kentucky Lottery Corporation to withhold delinquent amounts from prizes.
SFA (2, E. Scorsone) - Remove provisions relating to booting a vehicle.
SFA (3, R. Stivers) - Requires that parents of minor parents be notified of child support proceedings and their rights to appeal and contest the action.

Karem) - Requires the cabinet to include in administrative regulations requirements to be met before a vehicle is immobilized by booting; requires that a cancellation notice be sent to the obligee and the sheriff; requires that the cabinet attempt to reach a payment agreement; requires the cabinet to notify the Department of Vehicle Regulation to issue clear title upon sale.

HCA (2, G. Lindsay) - Delete amendment of KRS 403.212 relating to requiring grandparents to pay child support on their grandchildren when their children do not pay child support.
HFA (1, J. Vincent) - Require the Cabinet for Families and Children to obtain approval from a Circuit Court before booting a motor vehicle belonging to a person delinquent in the payment of child support.
HFA (2/P, R. Webb) - Create a new section of KRS 205.710 to 205.800 to permit certain county attorneys to appoint child support enforcement officers to assist in the execution or service of all forms of legal process relating to the establishment, enforcement, and collection of child support; permit deputy constables to serve as child support enforcement officers.

Stumbo) - Create a new section of KRS Chapter 48 to permit the Legislative Research Commission to declare an emergency and administer the legislative branch of government with public funds not to exceed appropriations provided for the immediately preceding fiscal year if general appropriations bill for the legislative branch is not enacted; permit the Chief Justice to declare an emergency and administer the judicial branch of government with public funds not to exceed appropriations provided for the immediately preceding fiscal year if general appropriations bill for the legislative branch is not enacted; restrict authorizations to maximum of one fiscal year; require investment of revenues received in excess of appropriations.
HFA (6, G.
