SB 223/CI (BR 2015) - G. Neal

     AN ACT relating to crimes and punishments.
     Amend KRS 506.140 to define "criminal gang" and "continuing pattern of criminal activity"; amend KRS 506.150 to set out distinguishing characteristics of gang membership; repeal KRS 506.130.

SB 223 - AMENDMENTS


     SFA (1, G. Neal) - Exclude from the definition of "criminal gang" entities such as fraternal organizations and associations, unless organized for the primary purpose of engaging in criminal activity; define "continuing pattern of criminal activity" to mean that, within a 2 year period, any member or members of a criminal gang, are convicted of the commission, attempt, or solicitation of two or more felonies, the commission of two or more violent misdemeanors, or a combination of at least one of these felonies and one of these violent misdemeanors; define "violent misdemeanor offense".
     HFA (1/P, H. Anderson) - Attach provisions of HB 913 to SB 223/GA.
     HFA (2/Title, H. Anderson) - Make title amendment.
     HFA (3/P, J. Gray) - Attach HB 529/GA to SB 223/GA.
     HFA (4/P, K. Bratcher) - Attach provisions of HB 1028.
     HFA (5, G. Stumbo) - Create a new section of KRS Chapter 48 to permit the Legislative Research Commission to declare an emergency and administer the legislative branch of government with public funds not to exceed appropriations provided for the immediately preceding fiscal year if general appropriations bill for the legislative branch is not enacted; permit the Chief Justice to declare an emergency and administer the judicial branch of government with public funds not to exceed appropriations provided for the immediately preceding fiscal year if general appropriations bill for the legislative branch is not enacted; restrict authorizations to maximum of one fiscal year; require investment of revenues received in excess of appropriations.
     HFA (6, G. Stumbo) - Create a new section of KRS Chapter 48 to permit the Governor to declare an emergency and administer the government with public funds not to exceed appropriations provided for the immediately preceding fiscal year if general appropriations bill for the executive branch is not enacted; restrict authorizations to maximum of one fiscal year; require investment of revenues received in excess of appropriations.
