     AN ACT relating to county budgets.
     Amend KRS 68.310, relating to county budgets, to decrease from sixty-five percent (65%) to fifty-five percent (55%) the amount of funds that can be expended during the first half of the fourth fiscal year of an administration; amend KRS 68.990 to specify penalties.

SB 255 - AMENDMENTS


     SCS - Retain original provisions of the bill and require that criminal prosecutions and actions to recover civil penalties be brought in the jurisdiction where the violation occurred.
     SFA (1, D. Kelly) - Amend Section 2(9)(a) to allow rather than require that civil penalties will be assessed on officers who violate the provisions of KRS 68.310 by expending more than fifty-five percent (55%) of the fourth year county budget.
     HCA (1, S. Riggs) - Amend subsection (9)(a) to specify that provisions of Section 1 apply to any county or state officer who "knowingly and willfully" violates the provisions rather than "knowingly"; lower the penalties for offenses set out in subparagraphs 2. and 3. to Class B and Class A misdemeanors respectively.
