SB 289 (BR 2170) - R. Stivers, J. Rose

     AN ACT relating to alien insurers.
     Establish Subtitle 50 of KRS Chapter 304 and create new sections thereof to provide for the regulation of alien insurance companies; provide for an alien insurer to use Kentucky as a port of entry to transact insurance in the United States through a U.S. branch; require the alien insurer to maintain a trust account; require the commissioner to approve the deed of trust; require the filing of annual and quarterly statements with the commissioner and the National Association of Insurance Commissioners; provide for issuance of a renewal of the certificate of authority to a U.S. branch; authorize the commissioner to proceed against an alien insurer under Subtitle 33 if the U.S. branch's trusteed surplus is inadequate.

SB 289 - AMENDMENTS


     SCA (1, T. Buford) - Amend to exempt Lloyd's Plan insurers unless the Lloyd's Plan insurer petitions the commissioner otherwise.
     HCS - Retain original provision but add a provision that Subtitle 49 of KRS Chapter 304 shall not apply to any alien insurer lawfully transacting the business of insurance in Kentucky prior to the effective date of this Act, unless the alien insurer petitions the commissioner of insurance requesting that the subtitle apply to the alien insurer.
     HFA (1, J. Bruce) - Exempts Lloyd's Plan insurers from the subtitle if they are licensed under Subtitle 28.
     HFA (2/P, S. Westrom) - Attach provisions of HB 67/SCS to SB 289/HCS.
     HFA (3/Title, S. Westrom) - Make title amendment.
     HFA (4, G. Stumbo) - Create a new section of KRS Chapter 48 to permit the Legislative Research Commission to declare an emergency and administer the legislative branch of government with public funds not to exceed appropriations provided for the immediately preceding fiscal year if general appropriations bill for the legislative branch is not enacted; permit the Chief Justice to declare an emergency and administer the judicial branch of government with public funds not to exceed appropriations provided for the immediately preceding fiscal year if general appropriations bill for the legislative branch is not enacted; restrict authorizations to maximum of one fiscal year; require investment of revenues received in excess of appropriations.
     HFA (5, G. Stumbo) - Create a new section of KRS Chapter 48 to permit the Governor to declare an emergency and administer the government with public funds not to exceed appropriations provided for the immediately preceding fiscal year if general appropriations bill for the executive branch is not enacted; restrict authorizations to maximum of one fiscal year; require investment of revenues received in excess of appropriations.
     HFA (6/Title, G. Stumbo) - Make title amendment.
     HFA (7, G.
