SB 293/FN (BR 1927) - D. Williams
AN ACT relating to the creation of the Kentucky Agency for Substance Abuse Policy.
Amend KRS 12.203 to create the Kentucky Agency for Substance Abuse Policy within the Office of the Governor; require KY-ASAP to have distinct programs directed toward youths and adults; provide that KY-ASAP be headed by an executive director and have staff and administer an endowment; establish 15-member board with oversight authority and provide for membership; require board to oversee deposits and expenditures from the endowment; require KY-ASAP to develop programs to target youth and adults and to develop a strategic plan to reduce the prevalence of smoking and drug and alcohol abuse among adults and youth; monitor smoking cessation and resistance and tobacco and substance abuse policies, make policy decisions to be followed by executive branch agencies, identify local resources, encourage coordination, act as repository of information, search for grant opportunities, make recommendations to local and state agencies, provide training, make grants, oversee school initiatives, develop media campaign, certify to the Governor and the General Assembly the extent to which each agency has cooperated with KY-ASAP, and report on best organization structure of state government that would provide coordination of services; create in each county a local tobacco addiction and substance abuse advisory and coordination board to assist in planning, overseeing, and coordinating local programs; require KY-ASAP to consult local leaders for advice on names of people to serve on the board; permit board to serve more than one county at the request of the county's; require board to develop long-term community strategy; amend KRS 222.021 to require representative of Kentucky Agency for Substance Abuse Policy to be member of the Substance Abuse, Pregnancy, and Women of Childbearing Age Work Group; amend KRS 222.037 to require pilot projects relating to smoking prevention; amend KRS 222.211 to require Cabinet for Health Services to comply with all policy and program recommendations and requests for information from the Kentucky Agency for Substance Abuse Policy; appropriate from any amounts designated to the Tobacco Settlement Agreement Fund created in KRS 248.654 the sum of $20,000,000 for fiscal year 2000-2001 and $20,000,000 for fiscal year 2001-2002.
SB 293 - AMENDMENTS
SCS/FN - Retain original provisions; increase board membership to 18 members and further define membership by specifying cabinets and agencies to be represented; increase quorum to 10 members; clarify that KY-ASAP shall promote implementation of research-based strategies that target youth and adults; clarify that KY-ASAP shall make policy recommendations, not decisions; permit KY-ASAP to act as referral source, rather than central repository, to assure availability of training and technical assistance, rather than providing it, and delete reference to conducting of research, and instead require review of existing research; require KY-ASAP to coordinate, not develop, media campaign; provide that local board shall be referred to as the Tobacco Addiction and Alcohol and Substance Abuse Advisory and Coordination Boards, and specify that local boards shall be developed, wherever possible, from local agencies or work groups, including local Kentucky Incentives for Prevention (KIP) project coalitions; delete the appropriation; require the Governor to utilize, to the extent possible, the existing infrastructure of the CHAMPIONS Drug Free Kentucky Office; and confirm Executive Order 99-145, which created the Substance Abuse Council, dated November 1, 1999, to the extent it is not otherwise confirmed or superseded by Act.
