SB 298/CI (BR 2285) - R. Leeper

     AN ACT relating to crimes and punishments.
     Create a new section of KRS Chapter 189A to require the installation of an ignition interlock device in a motor vehicle driven by a person at the conclusion of a second or subsequent revocation of that person's driver's license for driving under the influence; amend KRS 189A.410 to permit a repeat DUI offender to obtain a hardship driver's license which includes the requirement that the repeat offender installs an ignition interlock device in any motor vehicle driven by that person; create a new section of KRS Chapter 189A to establish ignition interlock penalties; amend KRS 189A.080, 189A.090, and 186.560 to conform; amend KRS 189.530 to establish the crime of possession of an open alcoholic beverage container in a motor vehicle; create a new section of KRS Chapter 222 to establish the crime of consumption of an alcoholic beverage in a motor vehicle; amend KRS 222.202 to conform; amend KRS 222.990 to establish a penalty for consumption of an alcoholic beverage in a motor vehicle; amend KRS 222.201 to conform.

SB 298 - AMENDMENTS


     SCA (1, R. Leeper) - Add to ignition interlock device requirements that the device can be applied for after serving one year of hard suspension and that ignition interlock devices must be installed on all vehicles owned or leased by the defendant.
     SFA (2, E. Scorsone) - Amend to permit judge rather than require judge to order the use of ignition interlock devices in second and third offense driving under the influence cases.
     SFA (3, R. Leeper) - Delete jail time from the penalties for possession of an open alcohol container in a motor vehicle and consumption of an alcoholic beverage in a motor vehicle.
     SFA (4, E. Scorsone) - Clarify that the judge may order the use of an ignition interlock in driving under the influence cases.
     HCS/CI - Delete original provisions of bill and replace with the provisions of the House Committee Substitute to HB 366, without the provisions of that substitute relating to a blood alcohol concentration of 0.08.
     HFA (1, R. Wilkey) - Delete provisions of bill and insert in lieu there the provisions of HB 366/GA.
     HFA (2/P, R. Wilkey) - Delete provisions of bill and insert provisions of HB 366/GA.
     HFA (3/P, R. Wilkey) - Delete provisions of bill and insert provisions of HB 366/GA in lieu thereof.
     HFA (4/P, J. Gray) - Attach HB 529/GA to SB 298/HCS.
