SB 3 (BR 87) - P. Herron Jr
AN ACT relating to insurance.
Create a new section of Subtitle 99 of KRS Chapter 304 to create the offense of operating an unsecured (insured) vehicle; provide that operator of vehicle has duty to ascertain if it is insured; provide same penalties as for owner of uninsured vehicle.
SB 3 - AMENDMENTS
SFA (1, P. Herron Jr) - Provide for language relating to affirmative defenses.
HFA (1, B. Heleringer) - Amend to require insurers to base premiums for liability motor vehicle coverage solely on the driving record of the insured, except a two (2) year premium for a new driver without an established driving record is permitted.
HFA (2, G. Lindsay) - Provide a defense for operating a motor vehicle without insurance that reasonable inquiry was made and the owner of the vehicle stated that the vehicle was insured; provide that an employee operating an employer's motor vehicle is exempt from prosecution under the section.
HFA (3, R. Palumbo) - Permit in a wrongful death action recovery of damages caused by the loss of decedent's enjoyment of life.
HFA (4/Title, R. Palumbo) - Make title amendment.
HFA (5, G. Stumbo) - Create a new section of KRS Chapter 48 to permit the Legislative Research Commission to declare an emergency and administer the legislative branch of government with public funds not to exceed appropriations provided for the immediately preceding fiscal year if general appropriations bill for the legislative branch is not enacted; permit the Chief Justice to declare an emergency and administer the judicial branch of government with public funds not to exceed appropriations provided for the immediately preceding fiscal year if general appropriations bill for the judicial branch is not enacted; restrict authorizations to maximum of one fiscal year; require investment of revenues received in excess of appropriations.
HFA (6, G. Stumbo) - Create a new section of KRS Chapter 48 to permit the Governor to declare an emergency and administer the executive branch of government with public funds not to exceed appropriations provided for the immediately preceding fiscal year if general appropriations bill for the executive branch is not enacted; restrict authorizations to maximum of one fiscal year; require investment of revenues received in excess of appropriations.
