SB 349/AA (BR 1959) - G. Johnson
AN ACT relating to retirement.
Create Chapters 16A, 61A, and 78A to establish new retirement provisions for persons in the Kentucky Employees Retirement System, the County Employees Retirement System, and the State Police Retirement System who are hired after July 1, 2001; amend KRS 16.505 to redefine delayed contribution payments to delete the employer contribution; amend KRS 61.510 to redefine delayed contribution payments to delete the employer contribution, creditable compensation to include an increase in the presumed salary for legislators, and final compensation to provide nonhazardous employees retiring between August 1, 2000, and January 31, 2005, benefits based on their high 3 years and those retiring between February 1, 2005, and January 31, 2006, benefits based on their high 4 years; amend KRS 61.545 and 61.552 to require most service purchases to be based on the new delayed contribution definition and delete some service purchases; amend KRS 61.555 to change the cost method for purchasing military service to delayed contribution; amend KRS 61.702 to require reemployeds to waive either the retiree insurance or the employers coverage; amend KRS 78.510 to redefine delayed contribution and final compensation as in KRS 61.510; amend KRS 78.606 to provide summer month purchase to delayed contribution payment; amend KRS 161.220 to provide persons hired after July 1, 2001, to retire with a high five calculation; amend KRS 6.520 to provide that a legislators assumed salary shall be one-twelfth of the annual assumed salary for legislators in KRS 61.510(13) for a member who retires pursuant to KRS 21.410 or who dies in office; create a new section of KRS Chapter 6 to require that legislator's final compensation for retirement purposes to be based on the assumed salary for legislator's set forth in KRS 61.510(13), for legislators currently in the legislative retirement plan, for legislators who have ceased contributing to the legislative retirement plan pursuant to KRS 21.360 and who are contributing to another system pursuant to KRS 61.680, unless that legislator is contributing to another retirement system, in which case the final compensation shall be based on the salary in that other retirement system; amend KRS 61.510 to increase the assumed salary for legislators for retirement purposes; amend KRS 61.680 to allow members of a state retirement system who are no longer contributing to that system in accordance with KRS 21.360, who are not employed in a nonelected position to opt out of membership in the Kentucky Employees Retirement System within 60 days of the effective date of the Act or within 60 days of the date the member ceases to contribute, whichever occurs last.
SB 349 - AMENDMENTS
SCS/AA - Retain original provisions for new hires with the following technical changes: clean up language on Rule of 85 for nonhazardous employees and Rule of 75 for hazardous employees, add Council on Postsecondary Education to KERS membership, change effective date of hazardous provisions and add sheriffs and deputy sheriffs certified under KRS 15.380, and insert current language on some disability provisions; provide that KRS service purchases not count toward eligibility for insurance; delete the high three for current KRS employees; and delete the revised assumed salary and benefit changes for legislators.
SFA (1, G. Johnson) - Clean up language on Rule of 85 for new hires nonhazardous and Rule of 75 for new hires hazardous; add Council on Postsecondary Education to KERS new hire membership; change effective date of new hazardous provisions and add sheriffs and deputy sheriffs certified under KRS 15.380 to that membership; provide that new service purchases not count toward insurance eligibility; delete new disability application/determination language in Section 12 and reference current language with exception for definitions for in line of duty and not in line of duty; revise medical examiner review to reflect current practice; make other conforming amendments.
SFA (2, G. Johnson) - Delete language in Section 12 concerning disability determination for new hires and reference current system with the exception that an incapacity shall be defined as being in the line of duty or not in the line of duty; revise medical examiner review to reflect current practice; and make other conforming technical amendments.
HCA (1, J. Bruce) - To provide that hazardous positions created after August 1, 2000, include jailers and deputy jailers if requested by their fiscal court and emergency medical personnel.
HFA (1, C. Belcher) - Provide current KERS and CERS employees who are in a nonhazardous position who retire between August 1, 2000, and January 31, 2005, with a retirement allowance based on the high three years.
HFA (2, B. DeWeese) - Include Probation and Parole Officers in the definition of hazardous duty retirement for the new system created after August 1, 2000.
HFA (3, W. Allen) - Retain provisions of GA bill and increase the assumed salary for legislators to $45,000, include CPI, allow member who is not employed in a non-elected position and who has ceased to contribute to the retirement system under KRS 21.360 to choose whether or not to opt out of the current system and begin contributing to the Kentucky Retirement Systems within 60 days of the effective date of this Act or within 60 days of the date the member ceases to contribute to the plan, whichever occurs later, amend KRS 6.520(1) to provide that final compensation for a legislator who retires under disability or who dies in office shall be one-twelfth of 100% of the annual assumed salary for legislators, provide that when a legislator makes application for benefits, that the benefits shall be based on the annual assumed salary for legislators, and provide effective date for the annual assumed salary for legislators.
HFA (4, G. Stumbo) - Create a new section of KRS Chapter 48 to permit the Governor to declare an emergency and administer the government with public funds not to exceed appropriations provided for the immediately preceding fiscal year if general appropriations bill is not enacted; require authorization to maximum of one fiscal year; require investment of revenues received in excess of appropriations.
HFA (5, G. Stumbo) - Create a new section of KRS Chapter 48 to permit the Legislative Research Commission to declare an emergency and administer the legislative branch of government with public funds not to exceed appropriations provided for the immediately preceding fiscal year if general appropriations bill for the legislative branch is not enacted; permit the Chief Justice to declare an emergency and administer the judicial branch of government with public funds not to exceed appropriations provided for the immediately preceding fiscal year if general appropriations bill for the judicial branch is not enacted; restrict authorizations to maximum of one fiscal year; require investment of revenues received in excess of appropriations.
