AN ACT relating to tobacco and declaring an emergency.
Amend KRS 141.010 to exclude from the income tax any amounts received from the national tobacco settlement; retroactively apply to tax years beginning after December 31, 1998; EMERGENCY.
SB 49 - AMENDMENTS
HCS - Retain original provisions; add the state legislative intent to protect Tobacco Price Support Program; establish Tobacco Contracting Commission; provide for appointment and membership terms; require any tobacco handler who purchases tobacco directly from producers to notify the commission; require commission to develop a model purchasing contract; require negotiations in good faith; direct the Tobacco Task Force to study tobacco contracting and sales and report findings and recommendations to the 2002 General Assembly.
HCA (1/Title, R. Adams) - Make title amendment.
HFA (1, R. Thomas) - Place a supplemental tax on those cigarettes sold by nonparticipating manufacturers and on gray market cigarettes at the rate of fifteen cents per pack; require the tax to be paid to the Revenue Cabinet and transferred to the tobacco settlement agreement fund.
HFA (2/Title, R. Thomas) - Make title amendment.
HFA (3, R. Thomas) - Place a supplemental tax on gray market cigarettes at the rate of fifteen cents per pack; require the tax to be paid to the Revenue Cabinet and transferred to the tobacco settlement agreement fund.
HFA (4, R. Thomas) - Place a supplemental tax on those who sell gray market cigarettes in the Commonwealth, who are not Nonparticipating Manufacturers as defined in the Master Settlement Agreement, at the rate of fifteen cents per pack; require the tax to be paid to the Revenue Cabinet and transferred to the tobacco settlement agreement fund.
HFA (5, H. Anderson) - Impose a tax of fifteen cents per carton on gray market cigarettes to be paid to the Revenue Cabinet and transferred to the tobacco settlement fund.
CCR - Committe cannot agree and requests Free Conference Committee be appointed.
FCCR (Majority Report) - Retains the original provisions of SB 49/GA and add to the exclusion from income tax, any amounts received from the Tobacco Loss Assistance Program (TLAP) for reduction in tobacco quota; add the state legislative intent to support the Tobacco Price Support Program and small tobacco farmers; direct the Tobacco Task Force to study tobacco contracting and purchasing, and its effect on the Tobacco Price Support Program and small farmers; direct the Tobacco Task Force to research issues involved with contracting including the development of tobacco contracting for the 2000 burley market, treatment of small producers, and the tobacco companies' views on contracting, and examine other states' approaches to tobacco contracting; direct the Tobacco Task Force to have at least 4 meetings and report findings and recommendations to the Legislative Research Commission and the Interim Joint Committee on Agriculture and Natural Resources by December 15, 2000; EMERGENCY.
