SB 96 (BR 1555) - J. Pendleton, W. Blevins, T. Buford, P. Herron Jr, B. Jackson, E. Miller, D. Seum, E. Tori, J. Westwood

     AN ACT relating to state employees.
     Amends KRS 18A.140 and KRS 151B.090 to set out permitted political activities that state employees may participate in and those that they shall not participate in; provides protections for state employees that choose to participate in such activities; amends 18A.990 to set the penalty for violation by participating in forbidden activities as a Class B misdemeanor.

SB 96 - AMENDMENTS


     SCS - Retain original provisions of the bill except add new language to Section 1(1) and Section 2(1) of the bill to provide that no employee shall be rewarded or discriminated against for refusing to engage in any prohibited activity as set forth in the bill; amend Section 1(4) and Section 2(4) to prohibit an employee from engaging in any allowed political activity while the employee is on duty, in a government office, wearing an official uniform, or while using a government vehicle.
     SFA (1, R. Roeding) - Amend KRS 18A.140, 151B.090, and 121.310 to provide that no person shall solicit or obtain contributions to a committee from an employee by use of an automatic method or deduction including a payroll deduction or reverse checkoff plan; provide that employee may participate in a payroll deduction plan if the employee affirmatively consents to the contribution at least once in each calendar year; provide that the contribution shall be voluntary and the consent to the deduction shall be revocable at any time; provide that this does not require the establishment of a payroll deduction program nor make lawful any contribution otherwise prohibited by state law; amend KRS 121.990 to provide that violation is a Class D felony.
