SB 98/FN (BR 1326) - J. Rose

     AN ACT relating to adult day health care programs.
     Create a new section of KRS Chapter 205 to define "adult day health care program"; require promulgation of administrative regulations to establish requirements for licensure; prohibit the operation of an adult day health care program without a license; establish appeal procedures for actions by the cabinet to deny, revoke, suspend, or modify a license; and establish services provided by an adult day health care program.

SB 98 - AMENDMENTS


     SCS - Retain original provisions; change KRS Chapter 205 to 216B; amend a new section of KRS Chapter 216B to delete description of individuals to be served; permit the cabinet to issue a license to an adult day health program upon request; limit services that may be provided; and make technical correction.
     HCS/FN - Retain provisions of SB 98/GA; amend 314.011 to provide that an advanced registered nurse practitioner may dispense samples of nonscheduled legend drugs; amend KRS 314.042 to provide that a nurse may dispense nonscheduled legend drugs; amend KRS 315.040 to provide that pharmacy laws shall not be interpreted as interfering with the activities of an advanced registered nurse practitioner under KRS Chapter 314; amend KRS 205.5632 to provide that FDA-approved prescription drugs that have been determined to be in the same pharmacological category, that have comparable clinical application, efficacy, and safety, and that are of comparable cost to other FDA-approved drugs that been placed on the Kentucky Medicaid nonprior-authorized drug file shall be placed on the Kentucky Medicaid nonprior-authorized drug file; provide that a drug that is removed from prior authorization shall be returned to prior authorization status if the comparable drug becomes prior authorized; require Department for Medicaid Services to file, no later than October 1, 2000, administrative regulations that describe the process that will be employed to describe drug comparability with regard to efficacy, safety, and cost; and define "pharmacological category."
     HCA (1/Title, T. Burch) - Make title amendment.
     HFA (1, M. Treesh) - Retain original provisions and create a new section of KRS Chapter 315 to prohibit a pharmacist who objects to dispensing medication that may terminate a pregnancy from liability; prohibit discrimination against a pharmacist who objects to dispensing medication that may terminate a pregnancy.
     HFA (2/Title, M. Treesh) - Make title amendment.
     HFA (3, M. Treesh) - Retain original provisions, amend 314.011 to limit dispensing of legend drugs by advanced registered nurse practitioners to free samples.
