HB 174 (BR 470) - R. Damron, S. Westrom, B. Colter
AN ACT relating to insurance.
Create a new section of KRS 304.14-600 to KRS 304.14-625 to require insurers providing coverage for assisted living benefits in a long term care policy to cover services received in any assisted living community meeting the requirements of KRS 194A.700 to KRS 194A.729 and any administrative regulations promulgated under KRS 194A.700 to KRS 194A.729; require insurers providing coverage for adult day care services in a long term care policy to provide coverage if the adult day care facility meets the requirements of KRS 205.950 or KRS 216B.0443 and any administrative regulations promulgated under KRS 205.950 or KRS 216B.0443.
HB 174 - AMENDMENTS
HFA (1, R. Damron) - Clarify that the Act applies to long term care policies that provide certain coverages.
SCS - Retain the original provisions; make technical changes to provisions on long term care insurance; amend KRS 304.17A-607 and 304.17A-617 to change references to "other alternative treatments" in the denial letter and the written notice of denial of coverage to "alternative benefits."
SFA (1, J. Denton) - Amend to prohibit the Department for Medicaid Services from implementing any policy that would conflict with the Supreme Court decision in Olmstead v. L.C., 527 U.S. 581 (1999) or hinder an individual who meets institutional level of care from receiving their care in a community setting; and require the department to request that the federal Health Care Financing Administration renew the current home and community based waiver prior to its expiration.
