HB 246 (BR 432) - J. Adams, R. Wilkey

     AN ACT relating to boards of ethics of local governments.
     Amend KRS 65.003 to permit cities and counties or agencies created jointly to enter into a memorandum of agreement for the creation of a joint code of ethics; specify that the agreements may provide for administrative services relating to the implementation of the code of ethics; create independent regional ethics boards that provide advice and enforcement of the ethics codes to member governments and permit contracts with area development districts for the provision of administrative services relating to the implementation of the codes; exempt non-paid members of jointly created agencies from disclosure of financial details.

HB 246 - AMENDMENTS


     HFA (1, R. Crimm) - Amend KRS 65.003 to require local governments to adopt as a part of their ethics codes language prohibiting planning commission members, and member, of the boards of zoning adjustment from directly soliciting political campaign contributions from their appointing authorities and provide for removal for violation of the provision.
     HFA (2, J. Adams) - Delete proposed language which would have permitted the issuance of subpoenas by ethics boards or their representatives.
     HFA (3, T. Riner) - Amend Section 1 to provide that each local government's code of ethics include a provision requiring planning commissioners and board of adjustment members to report the solicitation or receiving of any campaign contributions; set out reporting procedure, retroactivity, and contents, and declare that the reports be public records.
     HFA (4, T. Riner) - Amend Section 1 to provide that local codes of ethics contain a policy to require persons with regulatory oversight report any political campaign contribution to the person or group responsible for enforcing the local code of ethics; specify content of report and declare the report to be a public record.
     HFA (5, T. Riner) - Amend Section 1 of the bill to provide that local codes of ethics contain a policy to prohibit any person exercising regulatory oversight from soliciting campaign contributions from anyone that person has that regulatory oversight.
     HFA (6, R. Crimm) - Amend KRS 65.003 to require the boards of ethics in counties containing cities of the first class to adopt as a part of their ethics codes language prohibiting planning commission members and members of the boards of zoning adjustment from directly soliciting political campaign contributions and provide for removal for violation of provision.
