HB 301 (BR 113) - C. Geveden

     AN ACT relating to licensing motor vehicle operators.
     Amend KRS 186.570 to prohibit the Transportation Cabinet from suspending a driver's license based on the driver having lost his or her driving privileges in another state.

HB 301 - AMENDMENTS


     HCS - In subsection (4) return the provisions to existing law except limit the Transportation Cabinet's right to suspend a Kentucky driver license based upon offenses the driver committed in another state, to an offense that was committed within the past five years. In subsection (5) delete the brackets and strikethroughs to return the provisions to existing law.
     HFA (1, C. Geveden) - Delete the provisions of House Committee Substitute and insert new language to amend KRS 186.570, regarding suspension of an operator's license, to prohibit the Transportation Cabinet from suspending the license of a Kentucky resident for an out of state offense that is more than five years old; allow the state to deny the initial applications for a Kentucky from people whose licenses are suspended in other states as long as those suspension are in effect, and exclude CDLs from the suspension provisions; create a new section of KRS 186.400 to 186.640 to allow the holder of a Kentucky operator's license whose driving privileges have been suspended in another state to renew his or her license, specify that the license be stamped "VALID IN KENTUCKY ONLY"; require recipients of such licenses to sign a form stating that they understand they may be subject to arrest if stopped in other state while driving on the "Kentucky Only" license, and require the holder of such a license whose driving privileges are restored to go to the circuit clerk to receive a new license; amend KRS 186.860, 186.440, and 186.580 to conform; require the Transportation Cabinet to amend current administrative regulations and promulgate any new regulations required by this Act within ten days of the effective date of the Act; delay the effective date to October 1, 2001.
     HFA (2, K. Upchurch) - Amend to add a new section 2 to require law enforcement officers to impound the operator's license of drivers who cannot produce proof of insurance; allow a person whose license was impounded under subsection (1) to have the license returned when he or she present proof of insurance to the circuit clerk; and require officers to have another reason to stop the vehicle besides a violation of this section.
