AN ACT relating to real property of the Commonwealth.
Amend KRS 45A.045 to prohibit transfer of real property by the state for less than fair market value, or for little or no consideration, without an opportunity for a hearing before the Capital Projects and Bond Oversight Committee; create a new section of KRS Chapter 45A to create hearing procedure; amend KRS 56.463 to comply with hearing procedure requirement.
HB 338 - AMENDMENTS
HCS - Retain original provisions of the bill, except in Section 1(4) state that no interest in real property held by the state shall be transferred, leased, sold, or otherwise disposed of for less than the property's fair market value, and no interest in real property shall be transferred, leased, sold, or otherwise disposed of for no consideration or nominal consideration unless approved under Section 2 of this Act; amend Section 2(1) to require that prior to entering into any agreement to transfer, lease, sale, or otherwise dispose of the real property that the Cabinet shall review and concur with the appraisal or do an independent appraisal; require the Finance and Administration Cabinet prior to entering into an agreement to make a determination whether or not the property will remain in public use after the transfer and deed it as such, ensure that it is transferred according to the statutory requirements, or that it is transferred after competitive advertisement and negotiation; amend Section 3(3) to state that no interest in real property held by the state shall be transferred, leased, sold, or otherwise disposed of for less than the property's fair market value, and no interest in real property shall be transferred, leased, sold, or otherwise disposed of for no consideration or nominal consideration unless approved under Section 2 of this Act.
